    JKPSC Notification Regarding Conduct of PaperII of Prosecuting Officer Preliminary Examination

    In pursuance of Government Order No.352-JK(GAD) of 2023 dated 13.03.2023 the following Officers are deployed as Observers at the Examination Centre(s), as indicated against each, for conduct of Preliminary Examination for the post of Prosecuting Officer(G) in Home Department scheduled to be held on 16-03-2023 (Thursday) in one session timing 03:30 P.M to 05:30 P.M

    It is further ordered that the Observers shall report at the allotted Centre(s) at least one hour before the scheduled commencement of the Examination and shall leave the centre after dispatch of the sensitive material.

    SRINAGAR: Aspirants for Prosecuting Officers on Thursday urged Jammu and Kashmir Public Service Commission to cancel both papers instead of the one and conduct a fresh examination to provide “a level playing field” for all.

    JKPSC on Wednesday canceled “paper-II” which is qualifying with the further announcement that the examination for it will be conducted on March 16. However, several aspirants called the news agency GNS since the announcement was made close-of-day Wednesday, alleging that the cancelation of only paper II will provide an advantage to those aspirants who have scored better marks in paper-I and that decision “rides roughshod” over others.

    “As per the scheme of examination, both the papers have the importance of their own. The paper-I score will count only after one qualifies Paper-II,” the aspirants said, adding, “Had the JKPSC not canceled the paper-II ab-initio, those who are having a better score at present in paper-I would not make it to merit list and selection was to be made among those who qualified by having required numbers in paper-II.” Now that JKPSC has chosen to cancel only paper-II, it was providing undue advantage at the cost of others to some aspirants, they said.

    “This is clear injustice and unfair with most aspirants,” they said, adding, “It smacks of arbitrariness or to put it in other words, it is irrational and offends the basic requirement of Article 14 of the Constitution.”

    They said that with the announcement, the JKPSC was setting a “wrong precedent.”

    “The examination scheme is such that an aspirant has to first qualify the paper-II by getting a score as provided under the notification,” they said, adding, “By allowing somebody who has fared better in paper-I two chances is plain injustice. Does someone who has fared better on paper II and not so good on paper-I, also deserve two chances at paper-I?” This clearly, they said, was “unfair”.

    As per the JKPSC, its decision to cancel paper-II followed representations from the candidates through the J&K High Court Bar Association Jammu and others, claiming that the standard of the qualifying paper was higher than the level prescribed in the notification.

    “The JKPSC itself has admitted that representations received by it requested for re-conducting the examination, meaning both papers, or allowing the aspirants to appear in the main examination,” the aspirants said, adding, “The JKPSC has chosen to set a wrong precedent and we request the Commission to revisit its decision of only examining Paper-II, thereby allowing two chances to some aspirants and denying same opportunity to others.” (GNS)

    Srinagar, Mar 01: The Jammu and Kashmir Public Service Commission (JKPSC) on Wednesday cancelled the Paper-II (Qualifying) of J&K Prosecuting officer (Preliminary) Examination held on 29 January, 2023 and announced that fresh examination to be held on 16th March, 2023.

    According to an order, a copy of which lies with the news agency—Kashmir News Observer (KNO), the JKPSC said that examination held earlier was cancelled after the complaints were received that the examination of the Qualifying Paper II of preliminary examination was of a standard higher than the level prescribed in the notification.

    “The J&K PSC conducted the Preliminary Examination for filling up the posts of Prosecuting Officers in Home Department on 29.01.2022 in two shifts. The Examination comprised of two MCQ based papers conducted in two sessions on the said day. The Provisional Answer Keys for Paper- I & Paper-II (Qualifying) were notified seeking objections from the candidates within the stipulated period,” it added.

    “Along with the objections, various representations were received from the candidates through the J&K High Court Bar Association, Jammu and others, registering their grievance that the Examination of the Qualifying Paper II of the said Preliminary Examination was of a standard higher than the level prescribed in the notification and majority of them could not qualify the same,” it added.

    “It was requested to either re-conduct the Examination or allow all the aspirants to appear in the Mains Examination and the matter was examined in Commission and the Commission decided to conduct the Prosecuting Officer (Preliminary) Examination, Paper-II afresh,” the order reads.

    The JKPSC said that in view of the above stated facts and circumstances, it is ordered that the Paper-II (Qualifying) of J&K Prosecuting officer (Preliminary) Examination which was held on 29-01-2023 is cancelled ab-initio.

    “The fresh examination for the said paper shall be conducted on 16thMarch, 2023 at the centres to be notified separately,” the order added—(KNO)

    SRINAGAR: Jammu and Kashmir government on Thursday sacked an Assistant Prosecuting Officer from service, three years after eight gram contraband substance was recovered from his possession in Rajouri.

    Quoting an order news agency KNO reported that Waseem Ahmed Qureshi, the then Assistant Public Prosecutor in the Court of Judicial Magistrate, Ukhral while on his way to Rajouri on 04-05-2020 was found to be in possession of 8 gms of Contraband substance by a Police party of Rajouri Police.

    “A case FIR No. 230/2020 u/s 8(a), 21/29 of NDPS Act, 1985 was registered in Police Station, Rajouri. The Officer has acted in a manner unbecoming of a public servant and has also failed to maintain absolute integrity thus violating Rule 3(1)(i) and (iii) of J&K Government Employees(Conduct) Rules, 1971, Waseem Ahmed Qureshi, Prosecuting Officer (under suspension) was arrested on 10.02.2022 by Jammu Police for his alleged involvement in a case FIR No. 18/2022 u/s 8/12/22/25/29 of NDPS Act registered in Police Station, Nowabad for possession of Contraband substance. The Officer has acted in a manner, unbecoming of a public servant and has also failed to maintain absolute integrity thus violating Rule 3(1)(i) and (iii) of J&K Government Employees (Conduct) Rules, 1971 and his after his suspension vide Government Order No. 119- Home of 2020 dated 29.05.2020, failed to report in the office Deputy Director, Prosecution Ramban, where he was attached, w.e.f. 17.10.2021. The action of the Officer of not obeying the orders of the authorities is in Rule 3(1)(i) and (iii) of J&K Government Employees (Conduct) Rules, 1971,” it added.

    Accordingly, in terms of Rule 33 of the Jammu and Kashmir Civil Services (Classification, Control & Appeal) Rules, 1956, the government ordered an inquiry. “The Competent Authority, approved the report submitted by the Inquiry Officer and directed imposition of a penalty, provided in Rule 30(viii) of the Jammu and Kashmir Civil Services (Classification, Control & Appeal) Rules, 1956, upon the delinquent officer.”

    Pursuant to the decision of the Competent Authority and before imposing the penalty on Qureshi, a show cause notice dated 23 December 2022 alongwith the summary of the proceedings of the Inquiry was served upon Qureshi, giving him an opportunity to show cause, within a period of 15 days, as to why the penalty be not imposed on him, it reads.

    “Instead of responding to the show cause notice, the delinquent officer vide his reply dated 10.01.2023, inter-alia, stated that he should be given more time to respond to the show cause notice,” it further reads.

    “The reply submitted by the delinquent officer was examined in consultation with the DG, Prisons, J&K and it was observed that the delinquent officer was attempting to evade the penalty by narrating misleading facts,” the order said, adding, “It was further observed that the facts narrated in the reply had already been considered by the Inquiry Officer and the delinquent officer had failed to give any cogent reason, warranting consideration for imposing a lesser penalty.”

    “The reply given by the delinquent officer alongwith all the details were again placed before the Competent Authority and the Competent Authority chose not to change the decision of imposing the penalty of ‘dismissal from service of the State which ordinarily disqualifies from future employment’ upon the delinquent officer,” the order reads.

    “Now, therefore, in terms of Rule 30(viii) of the Jammu and Kashmir Civil Services (Classification, Control & Appeal) Rules, 1956, Shri Waseem Ahmed Qureshi, Prosecuting Officer is dismissed from service, with immediate effect, which will also disqualify him from future employment,” it added.
