    EPFO Penalty Proceedings Against Lawful Procedure: FCIK

    SRINAGAR: The Federation of Chambers of Kashmir (FCIK) has taken strong exception to the penalty proceedings launched by the Employees Provident Fund Organisation (EFPO) against hundreds of employers in Jammu and Kashmir valley under section 14B of the Provident Fund Act for making belated payments after respective due dates of filling of returns during January 2019 to April 2023 and has termed the action against the procedure established by law.

    In a statement, the FCIK has challenged the prudence of the organisation for having invoked section 14B of the Act which could only be done under concrete evidence regarding any culpable state of mind of the employer while committing default in timely remittances. FCIK stated that the action taken by EPFO had sent shockwaves to employers for the reason that this provision of the Provident Fund Act was extremely harsh and envisaged for recoveries through coercive methodology including attaching bank accounts and properties.

    FCIK regretted that EPFO J&K had completely played ignorant to the prolonged lockdowns during the reorganization of state, Covid restrictions coupled with snapping of internet services which had led to complete halt to business activities in Jammu and Kashmir during aforementioned time period and has asked that how could EPFO expect employers to follow normal rules and regulations under most abnormal conditions when the very movement of people had been restricted.

    FCIK has taken up the matter with Central Provident Fund Commissioner GOI with a plea to quash the demands raised by EPFO against J&K employers. While giving an overview of the operational and economic conditions of enterprises in J&K particularly in Kashmir valley, FCIK has solicited intervention of the CPFC for quashing of demands raised by EPFO J&K against employers for penal damages including interest and administrative charges during the period of January 2019 to April 2023. The waiver of penal damages was also sought in consideration of Central Provident Fund Organisation’s own Circular No C-1/Misc./2020-21/vol.1/1112 dated 15-05-2020 and relevant apex Court directions, reads the statement of FCIK.

    New Delhi: There is “no timeline” prescribed in the Memorandum of Procedure for transfer of high court judges, Law Minister Kiren Rijiju informed the Lok Sabha on Friday.

    The Memorandum of Procedure guides the appointment, elevation and transfer of judges of the Supreme Court and 25 high courts.

    In a written reply to a question in the Lok Sabha, he said that all transfers are to be made in “public interest” and for promoting better administration of justice throughout the country.

    Rijiju’s statement came days after the Supreme Court expressed displeasure over the Centre’s delay in clearing recommendations for transfer of some high court judges, saying it was a very serious issue.

    The minister said proposals for transfer of 10 high court judges are under various stages of processing.

    “No timeline has been prescribed in the Memorandum of Procedure (MoP) for transfer of judges from one high court to another…. As on February 6, 2023, proposals for transfer of 10 high court judges from one high court to other high courts are under various stages of processing,” Rijiju said.

    He said judges of high courts are transferred according to the procedure laid down in the MoP prepared in 1998.

    According to the existing MoP, the proposal for transfer of high court judges is initiated by the Chief Justice of India in consultation with four senior-most judges of the Supreme Court, he pointed out.

    The MoP further provides that the CJI is also expected to take into account the views of the chief justice of the high court from which the judge is to be transferred, as also the chief justice of the high court to which the transfer is to be effected, he said.

    Telangana: Procedure for govt teachers transfers/promotions to begin tomorrow

    Hyderabad: The Directorate of School Education released a detailed schedule for transfers and promotions of headmasters and teachers working in government and local body schools with the counseling process commencing from Friday.

    The seniority list for promotions of Gr-II headmasters and school assistants will be displayed on January 27. The current vacancy list of the category wise will be available on the website here. The online applications for the transfers will be received between January 28 and January 30.

    The teachers from high schools, primary and upper primary schools, and primary local body schools will have to submit hard copies of their applications with evidence before January 31 and February 2.

    Submission and verification of hard copies as well as online updation will be done by the district education officer (DEO) between February 3 to February 6.

    On February 7 and 8 provisional seniority lists with entitlement points for transfers and promotions will be made available on the DEO’s website.

    On February 8 to February 10, the redressal of objections will be taken based on seniority basis.

    Between February 11 and 12, the final seniority list of transfers for Gr-II headmasters will be displaced. Edit option for headmasters of zilla parishad management at the multi-zonal level and headmasters of government schools for rectification can be made on February 13.

    Their transfers will be announced on February 14.

    Display of Headmaster Gr-II vacancies will be made available on February 15 while promotions of school assistants as headmasters will be taken up between February 16 and February 18.

    The display of vacancies of school assistants of zilla parishad/government after their promotions as Gr-II Headmasters and exercising web options by school assistants for transfers/counseling in zilla parishad/government schools will be conducted between February 19 and 20.

    The edit option for their applications will be available on February 21.

    Transfer of school assistants and equivalent cadres will be taken up between February 22 and February 23.
