    The state court’s ruling issued Friday could also result in the U.S. Supreme Court dropping a closely watched case about the power of state legislatures over federal elections. The justices heard arguments on the issue in December, but signaled last month that they were considering changing course as a result of the effort to get the North Carolina court to reverse its earlier ruling.

    In a separate ruling, the court also overturned another one of its past decisions on a voter ID law, on a similar 5-2 split strictly along party lines. That ruling issued Friday will clear the way for a long-litigated photo ID law to go into effect in the state.

    Former Attorney General Eric Holder, who now runs a Democratic redistricting group, denounced the ruling as a nakedly political exercise.

    “This shameful, delegitimizing decision to allow the unjust, blatant manipulation of North Carolina’s voting districts was not a function of legal principle, it was a function of political personnel and partisan opportunism,” Holder said in a statement. “Neither the map nor the law have changed since last year’s landmark rulings — only the makeup of the majority of the North Carolina Supreme Court has changed.”

    The previous Democratic majority on the state court issued a series of recent decisions in the last year that ruled that partisan gerrymandering was illegal in North Carolina, while also blocking implementation of the state’s photo ID law. The new majority’s decision to rehear arguments on these cases so quickly was an unusual one, and many court observers believed the decision to do so meant that it was a matter of when, not if, the new court would allow for partisan gerrymandering.

    In a lengthy decision issued by the court Friday, the conservative justices concluded that they could not adjudicate claims of partisan gerrymandering, saying that is the role of the state legislature.

    “There is no judicially manageable standard by which to adjudicate partisan gerrymandering claims. Courts are not intended to meddle in policy matters,” Chief Justice Paul Newby wrote in his 144-page opinion for the court’s majority.

    Much of the majority’s rationale echoes that of a 2019 U.S. Supreme Court decision that found federal courts could not act against partisan gerrymandering, but left the question in individual states to their courts.

    “For a brief window in time, the power of deciding who is elected to office was given to the people, as required by the state constitution,” Justice Anita Earls wrote in her 72-page dissent, joined by Justice Michael Morgan. The two, who joined the court’s ruling last year striking down the map for being too partisan, are the last remaining Democratic jurists on the court.

    “Today, the majority strips the people of this right; it tells North Carolinians that the state constitution and the courts cannot protect their basic human right to self-governance and self-determination,” Earls added, declaring that her Republican colleagues’ “efforts to downplay the practice do not erase its consequences and the public will not be gaslighted.”

    Friday’s decision on partisan gerrymandering will likely cement Republican power in the state. The state legislature has the power to remake the state’s evenly split congressional delegation — unusually, the state’s chief executive, currently Democratic Gov. Roy Cooper, is explicitly left out of the process — and Republican lawmakers won’t need to negotiate with Democrats because the GOP has supermajorites in both chambers.

    The new maps will likely gravely endanger Democratic Reps. Kathy Manning in Greensboro, Wiley Nickel in the Raleigh suburbs and Jeff Jackson in Charlotte by placing them into Republican-leaning seats. Freshman Democratic Rep. Don Davis could also see his rural northeastern district become more competitive as well.

    Republicans could snag as many as 11 seats under a new map. Some GOP names to watch in potential new red seats: former Rep. Mark Walker, who has been eyeing a return to Congress while also teasing a run for governor; Bo Hines, who lost in 2022 to Nickel; and House Speaker Tim Moore.

    When Republicans first drew congressional lines after the 2020 census, they heavily favored their party. That map were heavily litigated and eventually struck down in state court, with court drawn maps instituted for the 2022 election only. The state legislature always expected to get another crack at redrawing the map ahead of 2024, and Friday’s ruling means that legislators could draw lines substantially similar to those the courts had previously thrown out.

    Moore, the state House speaker, has previously said before Friday’s ruling that he didn’t anticipate the legislature taking up the mapmaking process until the summer.

    Friday’s decision from North Carolina’s state Supreme Court could also have ramifications in the nation’s highest court.

    The U.S. Supreme Court heard arguments on Moore v. Harper, which is a challenge brought by Republican legislative leaders to the North Carolina Supreme Court decision overturning the original gerrymandered maps last year.

    That federal case advanced a once-fringe legal idea called the Independent State Legislature theory, which holds that under the U.S. constitution, state judiciaries have little — to no — authority to review state legislatures’ decision-making on laws around federal elections, including redistricting. At least four of the court’s conservative justices have in the past signaled, at a minimum, some friendliness to the theory — but during oral arguments in December it appeared that the court was not prepared to accept the most robust reading of the theory.

    The U.S. Supreme Court asked parties in the federal case to submit additional briefings on if the court still had jurisdiction over the federal case after North Carolina’s state Supreme Court’s decision to rehear the redistricting case earlier this year. That was a signal the nation’s top court is at least considering dismissing the case as improvidently granted, which is the court functionally saying it heard the case prematurely and will not be issuing a decision.

    Even some opponents of the independent state legislature theory feared the U.S. Supreme Court would dismiss the case. If it did so, it could mean there was no clear interpretation of the ISL theory heading into the 2024 election from the Supreme Court.

    The U.S. Supreme Court has not signaled a timeline for its next steps on Moore.

    New Delhi: Around 250 educationists and historians criticised the National Council of Educational Research and Training (NCERT) over its decision to revise textbooks. They said that removing the chapters was driven by a divisive and partisan agenda.

    The historians demanded NCERT withdraw the decision. Significantly, some sections related to Mughals were removed from the Class 12th History textbooks, and paragraphs that contained information about the ban briefly imposed on Rashtriya Swayamsevak Sangh (RSS) by the then government after the assassination of Mahatma Gandhi were omitted.

    Romila Thapar, Jayati Ghosh, Mridula Mukherjee, Apoorvanand, Irfan Habib and Upinder Singh, among others, have started a signature campaign to protest against the decision and for its withdrawal.

    On the other hand, the Democratic Teachers Front, an organisation of university-level teachers, said that if ‘WhatsApp University’ is given a free hand to devour Indian schools, colleges and universities, then Indian democracy will be seriously affected.

    NCERT said that the change made in school books has not been done with the aim of making anyone happy or angry.

    NCERT Chief Dinesh Prasad Saklani told IANS that the changes have been made purely on the basis of expert advice. He said that new books for all classes on the basis of the National Education Policy (NEP) will also be introduced and its work has been completed at the foundation level.

    Saklani said that changes were not only made in History books but also in books of other subjects to reduce the burden faced by students. He stated that the changes are not based on any particular person, event, period or institution.

    Saklani added that this is not a big change and all of them were made last year, keeping the Covid-19 pandemic in view and the academic loss faced by students worldwide, at all levels.

    In such a situation, NCERT decided to revise the course on the basis of experts’ opinions to reduce the burden on students who would return to school after a long time, Saklani concluded.

    How do you break through in a bipartisan way?

    Politics had nothing to do with dealing with how we clean up the mess from the train, for example, or how we hold the train company liable and accountable for this. So Pennsylvania Gov. Josh Shapiro and I both from the point of view of, “Hey, we got a problem. And let’s go fix it.” So yeah, I think there’s plenty of opportunity for people to work in a bipartisan way.

    Another example is Gov. Steve Beshear, in Kentucky, another Democrat. He and I are going to build a bridge across the Ohio River. We got the federal government and we got our money and his money, and we’re going to build a bridge. We’ve worked exceedingly well together.

    So, yeah, I think people want us to get things done. I think they don’t like partisan battles. You know, there are gonna be things that parties just are going to disagree about. And that is what it is. I have always found in my 20 years in Congress, particularly my 12 years in the U.S. Senate, as well as my time now as governor for the last four years, that you can find common ground. You can get things done.

    What are your policy goals for your second term?

    Since I took office, I have put an emphasis on mental health and fulfilling John Kennedy’s pledge in 1963, 50 years ago, to have mental health services available in every community in the country. From Day One, I put an emphasis on this. I provided in my first budget, my second budget now my third budget about $650 million for schools to use for mental health.

    When the pandemic hit, we put money directly into our colleges and universities for mental health for students. We continue to have a very aggressive budget. In regard to mental health, we’re also taking this into the communities. We have additional money in this budget, for example, if it’s approved by the legislature, in regard to the research. We’re not doing enough research in the area of mental health. So, that’s a priority.

    Prenatal care and pre-K education is also a priority and getting kids ready for school. Reading, as I told you, is important.

    Another area is community development. We have a proposal in our budget this year that I think is unique. And it is to set aside a half billion dollars in what we call the Ohio Future Fund and that is to help local communities when they have a prospective site that needs to be cleaned up or that needs to be gotten ready for developments. They can tap into that fund. I consider it a window of opportunity for Ohio.

    We are in a great position. Not only have we brought Intel chip fabrication plants into Ohio, but we’re having a groundbreaking for a new Honda facility to make electric batteries. This is really, I think, Ohio’s time.

    Republicans, meanwhile, decried what they suggested was a lack of transparent communication from the EPA, which has met skepticism for its assurances that the community’s air and water are safe.

    “A month after the accident, it’s clear to me that EPA’s risk communication strategy fell short,” said top committee Republican Shelley Moore Capito (R-W.Va.). “The initial delays in messaging and response has meant that the residents still do not trust these results enough to feel safe.”

    Republicans highlighted that first responders arriving on the scene didn’t immediately know what chemicals they were dealing with. In addition, residents still don’t believe EPA assurances that the air and water are safe because it still doesn’t smell right, Capito said. And, Republicans suggested that the EPA hasn’t provided direct answers on where the soil removed from the site is being shipped.

    Capito grilled Debra Shore, EPA’s regional administrator, about how it is handling waste removal at the accident site, echoing complaints from Ohio Republican Sen. J.D. Vance that large amounts of contaminated soil remain. When the soil is disturbed, “it brings the odor and then here comes a lack of trust right back down onto the community,” Capito said.

    Shore reported that tests of the contaminated soil revealed only low levels of dioxins, which will allow the waste to be transported to facilities qualified for disposal as soon as Thursday.

    Democrats also sought to pin down Norfolk Southern CEO Alan Shaw about whether his company will support a bipartisan rail bill that Vance is offering with senators including Ohio Democrat Sherrod Brown
    and Pennsylvania Democrat Bob Casey.

    “It’s bipartisan — that never happens around here on the big bills,” said Casey. “It’d be a good start by Norfolk Southern to tell us today — in addition to what they’re going to do for the people of Ohio and Pennsylvania — tell us today that they support the bill. That would help, if a major rail company said: ‘We support these reforms, and we’ll help you pass this bill.’”

    Shaw did not directly answer the question. But later in the hearing, Shaw praised provisions included in the bill that intend to tighten tank car standards and increase training for first responders. He also mentioned his desire to improve the devices on tracks that detect overheating wheels, which investigators are eyeing as a factor in the derailment.

    Other Democrats, including Brown and Vermont Independent Sen. Bernie Sanders, criticized Norfolk Southern for what they characterized as focusing more on profits than rail and chemical safety.

    “Norfolk Southern chose to invest much of its massive profits in making its executives and shareholders wealthy at the expense of Ohio communities along its rail tracks,” Brown said. He noted that in the last decade, Norfolk Southern eliminated 38 percent of its workforce.

    Sanders tried to get Shaw to commit to providing paid sick leave for its workers — one of the changes the Biden administration is seeking. Shaw demurred.

    At various points senators also sought to pin Shaw down on specific actions the railroad would take to make residents whole, including compensating people for long term medical costs and economic damages. Shaw responded to that and other attempts to pin him down on specifics with: “We’re committed to doing what’s right for the folks in East Palestine.”

    Sen. Bernie Sanders answered: “What’s right is to cover their health care needs. Will you do that?”

    Shaw only replied that “everything is on the table.”

    “All of us are committed to doing what’s right,” Sanders shot back. “But the devil is in the details.”

    Opening the hearing, Shaw apologized for the derailment and pledged “to improve safety immediately.”

    “I want to begin today by expressing how deeply sorry I am for the impact this has had on the residents of East Palestine and the surrounding communities,” Shaw said. “I am determined to make this right.”

    He said that while federal investigators have preliminarily found that the three-person crew behind the controls “was operating the train below the speed limit and in an approved manner,” it is still “clear the safety mechanisms in place were not enough.”

    Norfolk Southern has announced safety changes in the wake of the accident that are tailored to addressing the likely cause — an overheating wheel on a car carrying plastic pellets, which then caught fire. The railroad industry as a whole has also made new safety promises, though they are also tailored to the specific likely cause of the accident.

    Still, Shaw acknowledged that those voluntary initiatives “are just the start.”

    “The events of the last month are not who we are as a company,” Shaw said, referring not just to the East Palestine derailment but at least two other incidents since then, including one this week that resulted in the death of a conductor.

    Pottinger spiced up his testimony with a video of quotes by China’s paramount leader Xi Jinping that suggested hostile intentions toward the United States. Pottinger accused the Chinese government of waging “information warfare” on the U.S. and likened it to a series of magicians, calling the Chinese Communist Party “the Harry Houdini of Marxist-Leninist regimes; the David Copperfield of Communism; the Chris Angel of autocracy.” McMaster echoed that assessment and argued that some of the blame lies with leaders in academic, industry, finance and government who’ve exercised “wishful thinking and self-delusion” about China’s intentions.

    But the hearing revealed stark differences in how GOP and Democratic committee members perceive the U.S.-China rivalry and the strategies to approach it.

    Committee chair Mike Gallagher (R-Wis.) laid out a GOP vision of an external facing “existential struggle” against China’s “ideological, technological, economic and military threat.” Democratic committee members countered with a more domestic-focused approach hinged to bolstering U.S. democracy and backed by government funding for an industrial policy that ranking member Raja Krishnamoorthi (D-Ill.) said could thwart China’s challenge “through investments in technologies of the future, workforce improvement and by fixing weaknesses in our economy.”

    And Democratic members made implicit reference to Rep. Lance Gooden’s (R-Texas) statement on Fox News on Feb. 22 in which he questioned Rep. Judy Chu’s (D-Calif) loyalty or competence — a sign of the divides that could undermine the committee. “Calling into question the loyalty of Chinese Americans, as a member of Congress recently did, is as dangerous as it is deplorable,” said Rep. Ritchie Torres (D-N.Y.). Neither Chu nor Gooden are members of the committee.

    Gallagher and Krishnamoorthi have also rejected Gooden’s comments. Still, the divisions on display at the hearing suggest they face serious challenges from day one in delivering on their commitment to keep the committee’s focus on China rather than GOP-Democratic bickering.

    “Just because this Congress is divided, we cannot afford to waste the next two years lingering in legislative limbo or pandering for the press,” Gallagher said in opening remarks. And he warned that a failure by the U.S. to respond decisively to the Chinese government’s threat means “a world crowded with techno-totalitarian surveillance states where human rights are subordinate to the whims of the Party.”

    That tone captures the growing congressional concern about China following the discovery and subsequent destruction of a Chinese spy balloon over the continental U.S. in February. Biden administration warnings that the Chinese government is considering providing lethal weaponry to Russia in its war against Ukraine have only fanned those fears. And a Department of Energy report leaked on Sunday that concluded that a laboratory leak in Wuhan, China sparked the Covid pandemic has renewed congressional anger toward China’s role in a pandemic that has killed more than a million Americans.

    Bipartisan antagonism toward the Chinese government led the House Financial Services Committee to approve 10 bills on Tuesday aimed to rein in Beijing’s economic power. That legislation included measures that would target Chinese manufacturing of synthetic drugs, and commission a Treasury Department report on the global economic risks associated with China’s financial sector.

    But while GOP China committee members focused mainly on well-trod U.S-China hot button issues, including the role of Chinese-sourced precursor chemicals in the U.S. opioid overdose epidemic, concerns about Chinese purchases of agricultural land and the plight of Muslim Uyghurs in Xinjiang, Democratic members called for domestic policy initiatives to offset challenges from China.

    Reps. Ro Khanna (D-Calif) and Haley Stevens (D-Mich.) called for the U.S. to develop an industrial policy that would fund the development of manufacturers to supplant China’s dominance of global supply chains in areas including the supply of semiconductors for consumer products. “It provides dividends not only to our economy, but to our national security, to invest in R&D and invest in our manufacturing sector,” Stevens said.

    There were no takers among GOP committee members. “The United States should not mimic the Chinese industrial policy and should not copy the Chinese command and control system. … We should not try to counter China by becoming more like China,” said Rep. Andy Barr (R-Ky.)

    Democratic members argued, meanwhile, that facing down China’s authoritarian threat required a concerted effort to bolster what they described as America’s ailing democracy. Rep. Jake Auchincloss (R-Mass.) described the Jan. 6, 2021 insurrection as a propaganda gift to Beijing. That day “was Xi Jinping’s best day in office,” said Auchincloss. “I hope the bipartisan spirit of competing with the Chinese Communist Party overseas extends to defending democracy here at home.”
