  • SC refuses to stay conviction of Abdullah Azam Khan in criminal case, seeks UP’s reply

SC refuses to stay conviction of Abdullah Azam Khan in criminal case, seeks UP’s reply

    [ad_1]

New Delhi: The Supreme Court on Wednesday refused to stay the conviction and sentence of senior Samajwadi Party (SP) leader Azam Khan’s son Abdullah Azam Khan in a 15-year-old case without hearing the state.

A bench of justices KM Joseph and BV Nagarathna asked senior advocate Vivek Tankha and advocate Sumeer Sodhi to serve the copy of the petition to the standing counsel of Uttar Pradesh government and posted the matter for further hearing on April 5.

Tankha said Khan was a juvenile at the time of offence and hence his conviction and sentence be stayed.

“Sorry, for that we will have to hear the state also,” the bench said.

During the hearing, Tankha said Khan was juvenile at the time of incident and the high court has erred in not staying the session court’s order.

In his plea filed through Sodhi, Khan said he has challenged the order of Allahabad High Court dated March 17 by which it had asked the state to respond to the appeal in three weeks.

“The high court failed to appreciate the fact that if the application is not decided expeditiously then the same would be rendered infructuous and the petitioner would suffer irreparable harm which no court of competent jurisdiction would be able to undo even if the application is decided in favour of the petitioner,” it said.

Giving the detail of the case, he said the trial court had on February 13, convicted him for offences punishable under section 353 and 341 of IPC and other offences and sentenced him to undergo two years of simple imprisonment with a fine of Rs 2,000.

He said subsequent to the order of the trial court, the Uttar Pradesh Legislative Assembly secretariat on February 15, notified that Suar constituency of Rampur district of Uttar Pradesh has become vacant with effect from February 13.

Khan said he appealed the verdict of the trial court before additional sessions judge Rampur and also filed an application for stay of conviction and sentence but the court on February 28 dismissed the plea and application.

He said that on the same day he approached the high court against the order of the sessions court but the high court on March 17, granted a time period of three weeks to the state government to respond to his plea.

“In a nutshell, the case of the SLP petitioner before this court is that the impugned order passed by the high court is bad in law as the said order is passed without taking into account the urgent requirement of the issues involved in the application preferred by the petitioner,” the plea said.

Khan said that non-adjudication of his application in a time bound manner would render the same infructuous and therefore it is imperative that the high court considers the application as soon as possible, given the potential consequences of the conviction and sentence, which may include re-election on his assembly seat in the assembly.

“The petitioner believes that during the pendency of the application before the high court, by-election to the Rampur constituency would be announced. The petitioner is concerned that if such an announcement is made and thereafter, the high court passes a stay order the same would be rendered moot due to the announcement of the by-elections,” his plea said.

Khan said his conviction is legally unsustainable as he was a minor when the offence was committed.

“There are judicial orders to the effect that the date of birth of the petitioner is January 1, 1993, hence the petitioner was merely 15 years old at the time of commission of the offence in question. Accordingly, the entire trial proceedings are flawed,” he said.

The FIR against Khan, Azam and seven others was lodged in 2008.

Khan had sat on dharna on a state highway on January 29, 2008 as their cavalcade was stopped by police for checking in the wake of an attack on a Central Reserve Police Force (CRPF) camp in Rampur in Uttar Pradesh on December 31, 2007.

The FIR was lodged at the Chhajlait police station.

While Khan and Azam were sentenced to two years in jail under section 353 (criminal force to deter public servant from discharge of his duty) and other provisions of the Indian Penal Code (IPC), the seven other accused were exonerated.

Salman Khan threat email: Mumbai cops apprehend man from Rajasthan

    [ad_1]

Mumbai: The Mumbai police have apprehended a man from Rajasthan in connection with an email threatening actor Salman Khan that was received at the latter’s office here recently, an official said on Sunday.

The man, a resident of Rajasthan, was nabbed by the team of Bandra police station and is being brought to Mumbai, an official said.

The complaint about the threat e-mail was recently lodged at the Bandra police station by one Prashant Gunjalkar, who according to police, frequently visits the Bandra-based residence of Salman Khan and runs an artist management company.

When Gunjalkar was present in Khan’s office in Galaxy Apartment recently, he noticed an email had been received from the ID “Rohit Garg”. The sender of the e-mail, written in Hindi, said: “Goldy Bhai (gangster Goldy Brar) wanted to talk to Salman Khan face-to-face to close the matter”, adding, “Agli baar, jhatka dekhne ko milega (You’ll see something shocking)”, the police had said.

“After a detailed technical investigation into the case, police got information about the accused person’s whereabouts, following which a team was sent to Rajasthan and the man was apprehended,” the official said.

  • Rahul Gandhi or Azam Khan, legislators disqualified on basis of law: UP minister

Rahul Gandhi or Azam Khan, legislators disqualified on basis of law: UP minister

    [ad_1]

Noida: Uttar Pradesh minister Asim Arun on Saturday said the rule of law applies to everyone whether it is Congress leader Rahul Gandhi, SP’s Azam Khan or a BJP politician.

Responding to an allegation by Samajwadi Party chief Akhilesh Yadav, who has said that the BJP was trying to lodge false cases against opposition leaders and get them disqualified, the social welfare minister said a member of the ruling BJP had to lose his membership of the UP Assembly last year after his conviction.

Vikram Saini, a two-term MLA from Khatauli, was disqualified as a legislator in 2022 after he was sentenced to two years in prison by a court in a case related to the 2013 Muzaffarnagar riots.

“He had a criminal case against him and he got convicted in it. His seat fell vacant and bye-election was held on it,” Arun said.

The BJP fielded his wife in the bye-election but the RLD candidate won from there.

“The crucial element here is we all know what Rahul Gandhi said. Do you feel it amounts to defamation? I feel yes, it does. You read the lawbook and according to Section 499 (of the IPC), it is clearly defamation,” Arun said.

“Second, the speed of justice. The case was lodged in 2019 and it’s almost four years and the speed should be even greater, particularly for MP/MLA courts because they were made to ensure speedy legal proceedings in such cases,” the former IPS officer said during a visit to the National Capital Region.

Whether it is Azam Khan or his son Abdullah, every case has gone through a robust legal process, he said.

“Now Rahul Gandhi or other politicians who have been convicted have legal recourse and I am sure they must have taken that route. Either their conviction may not have got commuted or the sentence stayed because of which they have been disqualified. This is fundamentally about the rule of law, which must apply to everyone including politicians, which is happening,” the minister said.

Gandhi was sentenced to two years in jail after a Surat court convicted him in a 2019 criminal defamation case on Thursday. The next day, the Lok Sabha Secretariat issued a notification disqualifying him as an MP.

Imran Khan gets protective bail in two terrorism-related cases

    [ad_1]

Lahore: Pakistan Tehreek-e-Insaaf (PTI) Chairman Imran Khan on Tuesday secured a protective bail from the Lahore High Court (LHC) in two terrorism cases registered against him in Islamabad post-clashes at the Federal Judicial Complex (FJC) held last week, Dawn reported.

An FIR was registered against Imran Khan at the Counter Terrorism Department (CTD) and the Glora police stations in Islamabad accusing the PTI chief and party workers of their involvement in attacking cops and creating a situation of unrest outside the FJC in Islamabad during the Toshakhana case hearing on March 18.

Imran Khan was granted protective bail in the terrorism cases until March 27 by a two-judge LHC bench comprising Justice Shehbaz Rizvi and Justice Farooq Haider.

Khan arrived at the LHC on Tuesday at around 1 pm. According to a Dawn correspondent in court, the ex-premier’s vehicle entered LHC through the Mosque Gate.

Fawad Chaudhry, a PTI aide, party lawyers, and private security guards accompanied the PTI chairman.

Imran has renewed his claims that his life is in danger, saying that the incumbent rulers wanted to kill him and that a “trap” was set up at the Islamabad Judicial Complex on Saturday during the Toshakhana hearing. Last year, the PTI chief survived an assassination attempt and blamed the senior government and military figures for it.

Justice Sheikh of the LHC also heard a separate petition filed by the PTI on Tuesday seeking records of cases against the former prime minister.

The police presented a report in court during the hearing, stating that six cases had been filed against Imran Khan in Punjab. Three of these FIRs were filed at the Race Course police station in Lahore. In contrast, others were filed at the Sarwar Road police station, the New Airport police station in Rawalpindi, and the Madina Town police station in Faisalabad, according to Dawn.

However, Justice Sheikh directed the police to submit information about cases filed against Imran by the Federal Investigation Agency (FIR) and the National Accountability Bureau (NAB).

Khan also obtained bail in two summonses issued by the National Accountability Bureau (NAB) in the Toshakhana investigation before leaving the LHC.

The NAB Rawalpindi summoned the PTI chief to record his statements in connection with the Toshakhana gifts case on March 9 and March 21. Khan is accused of keeping some state gifts given to him by various foreign dignitaries, including Rolex wristwatches, which he allegedly bought on the cheap and then sold for millions of rupees, Dawn reported.
