Power Supply To Azad, Ravinder Raina, Langeh Snapped

SRINAGAR: Jammu Power Distribution Corporation (JPDCL) is reported to have snapped the power supply lines to the residences of Ghulam Nabi Azad and Ravinder Raina. They have not paid their bills.
A Delhi newspaper said they confirmed from one of the relatives of Azad and the power line has been snapped on Saturday.
Other politicians whose power supply lines have been snapped for non payment of tariff include BJP’s Neelam Langeh, a Ramban lawmaker.
All the three like-minded politicians are living in government owned accommodation Gandhi Nagar.
Off late, authorities have started resorting to denial of service in two cases. In Srinagar, a locality saw the power supply being snapped for the resident’s campaign against the installation of power meters. A report from Jammu said residents of Balmaki Colony have also had their power supplies snapped as they had not paid their bills for a long time.
Reports said a restaurant chain is also going to face music for not paying the power arrears.
The power supply halt came after a poor response to the amnesty scheme announced y the government asking 550 thousand consumers across Jammu and Kashmir to clear an outstanding of Rs 937 crore in easy instalments.

Division Bench Affirms Life Imprisonment Of Militant

SRINAGAR: The Jammu & Kashmir and Ladakh High Court’s Division Bench, consisting of Justice Rajnesh Oswal and Justice Mohan Lal, has affirmed the life imprisonment sentence given by Additional Sessions Judge Handwara to militant Mushtaq Ahmad Malla.
As per the prosecution’s version of events, on 22.12.2005, the Handwara Police Station received information that two militants, one of whom was identified as Mushtaq Ahmad Malla, the son of Ghulam Ahmad Malla from Shotgund, had shot and killed Tariq Ahmad Malik, the son of Abdul Qayoom Malik from Guloora, indiscriminately at Adoura, leaving his corpse at the scene.
Upon receiving this information, First Information Report (FIR) No. 337/2005 was filed for the alleged offenses under Sections 302 of the Ranbir Penal Code (RPC) and Section 7/27 of the Arms Act. Following the conclusion of the investigation, the accused was presented with a challan and subsequently sentenced to life imprisonment on December 31, 2021. After hearing arguments from both parties, the Division Bench (DB) noted that the trial court had considered and addressed all of the accused-appellant’s concerns following the law, citing various judgments from the Apex Court.
“The trial court, though it convicted the appellant for the commission of an offense punishable under Section 7/27 of the Arms Act, rightly did not sentence him for the punishment prescribed under Sub Section 3 of Section 27 of the Arms Act because the Apex Court has declared the Sub Section 3 of Section 27 of Arms Act as unconstitutional,” the DB stated. Furthermore, the DB noted, “the trial court has sentenced the appellant to undergo imprisonment for life after holding him guilty of the offense punishable under Section 302 of the RPC, and we do not find that the sentence of life imprisonment awarded to the appellant is disproportionate to the offense committed by him, particularly when Section 302 RPC provides punishment of either death penalty or imprisonment for life.”
“We also find that the trial court has rightly convicted the appellant for the commission of the offense under Section 201 of the RPC, particularly when there was direct evidence regarding the killing of the deceased by the appellant by gun and subsequently running away from the appellant from the place of occurrence with a gun,” the DB added. The DB concluded by stating, “we do not find any illegality or infirmity in the judgment of conviction and order of sentence dated 31.12.2021 passed by the trial court.”

Soldier Arrested For ‘Killing’ His Colleague

SRINAGAR: The Jammu and Kashmir Police on Saturday have been apprehended an army personnel for reportedly murdering his colleague inside an army barrack located in Samba district last year.
The police discovered the body of 21-year-old Sepoy Pawar Prathamesh, who hailed from Maharashtra, with a bullet wound on May 20, 2022. Following the discovery, inquest proceedings were conducted, according to a police official.
After conducting a thorough investigation under the guidance of Samba Senior Superintendent of Police Benam Tosh, the inquest proceedings were closed and a murder case was registered at Samba police station, based on the collected evidence, according to an official.
The suspect, Sepoy Vaidya Khushrang from Maharashtra, was apprehended and the murder weapon, an AK assault rifle, was confiscated. The official added that the inquest proceedings were conducted professionally, considering all evidence and aspects, and were closed with the murder case being filed on its merits.

HC Orders Eviction Of Illegal Occupants On Migrant Property

SRINAGAR: The High Court has ruled that to possess migrant immovable property, a person must have written consent from the migrant and the authority of law. If they fail to establish this consent, then the authority has the right to evict and take over possession of the property. This decision was upheld in the case of Abdul Khaliq Rather, who had challenged the District Magistrate Baramulla order to evict him from 04 Kanals and 5 ½ Marlas of migrant land in Awrenbal, Sonawari, Sumbal. The land was subsequently placed under the possession of the Deputy Commissioner, Bandipora.
On September 18, 2018, the Writ Court rejected Rather’s petition because he had not provided any evidence to prove his lawful possession of the migrant immovable property and because he had the option to appeal under the relevant statute. The Division Bench of Justice Rajnesh Oswal and Justice Mohan Lal further stated that a person occupying the migrant immovable property must show written consent and lawful authority, and if they cannot, then an eviction order can be passed. Additionally, if the competent authority has determined the possession to be unauthorized, then handing over possession for an appeal is not considered a burden.
The Court accused Rather of fabricating a story about an undertaking between him and the migrant owner to evade the time limit for filing an appeal under Section 7 of the 1997 Act. The Division Bench was not convinced by Rather’s claim that he had owned the property since before 1971, and that the owners had given him possession through a ‘Hundi’ in 1987, as there was no documentary evidence to support this. The appellant-counsel’s arguments were dismissed by the Division Bench.
The writ court’s judgment was challenged on the grounds that it disregarded the fact that Rather was and still is occupying the land with the consent of the actual owner. It was argued that if the possession was with consent, then the concerned authority would not have the jurisdiction to pass an eviction order, as their jurisdiction under Section 5 of the Jammu and Kashmir Migrant Immovable Property Act, 1997 only applies to cases of unauthorized occupation of migrant immovable property. The writ petition was originally filed by the migrants, and on October 13, 2005, the court directed the District Magistrate Deputy Commissioner, Baramulla to promptly hear all parties involved in the dispute and decide on the complaint of the actual property owners in accordance with the law.

Mercury Rises Amid Forecast For Cloudy Weather, Light Rains In JK

SRINAGAR: Amid forecast for generally cloudy weather with light rain at isolated to scattered places, the minimum temperature recorded increase in Jammu and Kashmir on Sunday.
A meteorological department official said that Srinagar recorded a low of 4.2°C against 3.4°C on the previous night and it was 0.5°C above normal for the summer capital.
Qazigund, he said, recorded a low of 3.2°C against 2.4°C on the previous night and it was 0.9°C above normal for the gateway town of Kashmir.
Pahalgam, he said, recorded a low of 0.6°C against minus 0.4°C on the previous night and it was 1.8°C above normal for the famous tourist resort in south Kashmir’s Anantnag district.
Kokernag recorded a low of 6.5°C against 5.3°C on the previous night and it was 4.0°C above normal for the place, the officials said.
Gulmarg recorded a low of 2.2°C against 2.0°C on the previous night and it was 5.5°C above normal for the world famous skiing resort in north Kashmir’s Baramulla district, he said.
In Kupwara town, he said, the mercury settled at 1.5°C against 1.2°C on the previous night and it was 0.8°C below normal for the north Kashmir area.
Jammu recorded a low of 15.8°C against 15.5°C on the previous night. It was 1.8°C above normal for J&K’s winter capital, he said.

Banihal, he said, recorded a low of 5.6°C (above normal by 1.4°C), Batote 10.5°C (above normal by 3.8°C), Katra 15.3°C (3.6°C above normal) and Bhadarwah 7.5°C (4.5°C above normal).
Ladakh’s Leh and Drass, he said, recorded a low of minus 3.6°C and minus 11.6°C respectively.
He said generally cloudy weather with light rain at isolated to scattered places was expected on March 13. From 14th-17th, he said, generally cloudy weather with dry weather was expected.
“Afternoon thunderstorms at isolated places can’t be ruled out,” the official said, adding, “Generally cloudy with intermittent light rain with thunder at scattered places was expected during March 18-21.”

All JK Patwar Association Calls off Strike After 11 Days

SRINAGAR: The All Jammu and Kashmir Patwar Association called off its strike after eleven days on Saturday. The announcement was made by the Association President after holding virtual meetings with the Divisional Commissioner and other regional offices of both Jammu and Kashmir.
Addressing a presser, the All Jammu and Kashmir Patwar Association President Abdul Majeed, as per the news agency GNS said that a meeting was held between the Patwar association and several government offices in an attempt to resolve the issue.
“The meetings were held in several phases and the first phase particularly was contentious”, he said adding the government offices tried to dissuade the Association, but members of the Association stood firm with their demands.

“After the first phase, two more meetings were held. One of these meetings was conducted via video conference and was attended by the Commissioner Secretary of Revenue and other officials from Jammu,” he said. “The meeting was supervised by the Divisional Commissioner of Kashmir amid the presence of the members of the Association.”
During these meetings, Majeed said, “the government requested three months to resolve the issue. However, the members of the Patwar Association resented the proposal, as they believe that the issues have already been lingering for too long. As a result, they proposed an alternative time of one month, which after a consensus the government agreed to.”
“The Association as such decided to defer its strike for one month”, Majeed said adding that if the government fails to take concrete steps towards resolving the issue within the given period, they will resume their strike.
“The members of the association are hopeful that the government will take their demands seriously and work towards a mutually beneficial solution,” he further opined. (GNS)

BJPs Rana Says All Party Participants Are Rejected, Dejected, Confused, Frustrated Politicians

SRINAGAR: In a scathing remark, Senior BJP leader Devender Singh Rana criticized the all-party meeting organized by opposition parties in Jammu, labeling it as an assembly of “rejected, dejected, confused, and frustrated” politicians. He claimed that these politicians are unnerved by the momentous changes brought about in Jammu and Kashmir by Prime Minister Narendra Modi. Rana asserted that these changes have steered the Union Territory from a dark alley of death, destruction, and gloom to become a bright, resurgent, peaceful, and developing part of the country.
“The opposition cannot derail Jammu and Kashmir’s tryst with peace and normalcy”, he said and cautioned the opposition not to assume the role of agent provocateurs to mislead the people for furthering their nefarious political agenda.
In an informal interaction with the media persons, Rana stated that “the meet is yet another non-event of all those who have developed vested interest over the decades in boiling Kashmir to bake their political loaves and sustain their enterprise.” He further commented that “peace and normalcy across Jammu and Kashmir is a sort of threat for their political existence and thus they smell a rat in all that is being done for the overall good of the UT.”
“Politically mature people understand the gimmicks of the self-seeking political actors, who can go to any extent for remaining relevant in politics,” he stated.
He further remarked that “their negative and obstructive political campaigns will not deviate the efforts of heralding complete normalcy to which the BJP is committed.” Rana also highlighted the fast-changing scenario in the Valley, stating that “last year witnessed record tourist footfall that was incomprehensible years ago when Kashmir was pushed to a dark alley of bandhs and stone pelting.” He added that “such a scenario had become a new normal. That situation has now totally changed, with economic activity gaining momentum, development getting impetus, and the people’s participation in governance becoming predominantly discernible.”
As per Rana, “Some political entities obviously feel uncomfortable with normalcy dawning and the UT treading on the path of development and prosperity.” He also stated that “the peaceful and resurgent Jammu and Kashmir goes against their scheme of things.” The minister emphasized that “every segment of society is part of the growth story,” and those who pretend to be oblivious to the changes taking place in both regions, regardless of religion and caste, are betraying their sense of understanding.”

Jammu Kashmir Politicians To Meet EC, Central Leaders For Early Polls, Statehood

SRINAGAR: The non-BJP all-party meeting in Jammu convened by Dr Farooq Abdullah has decided that they will meet the Election Commission for early elections in federally ruled Jammu and Kashmir. They said the Lt Governor-led dispensation does not represent the people of the erstwhile state.

“There is uncertainty everywhere in Jammu and Kashmir. It is the right of State Assembly to take a call on imposition of property tax like issues,” Dr Farooq has told the meeting. “This is a temporary government. It is not a people’s government. It is a government of Delhi. People’s government is Assembly where members have to decide what is right and what is wrong.”
Dr Abdullah told reporters that religion was used to create division between Hindus and Muslims in the region. “We must not forget that Jammu and Kashmir is a secular state and will remain secular. All faiths in the region live shoulder-by-shoulder together. Jammu and Kashmir is the crown of India and with the grace of God, it will remain the Crown of India in future as well,” he told the reporters after the meeting was over.
Regretting the politics of division, Dr Abdullah asked: “The politics of fear and hate is not new. What will they do to 22-24 crore Muslims? Will they throw them in the sea or will they send them to China?”
Dr Abdullah called for the restoration of statehood and early elections. “We want Statehood to be restored and elections to be held. For the first time in the history of the nation, a proud State was reduced to a Union Territory (UT). It was a tragedy,” Dr Abdullah said. “We are an integral part of the nation. We belong to this nation, so why are they doing this to us?”
Insisting that there was an uncalled delay in starting the democratic process, Dr Abdullah said the administration is claiming an improvement in the situation. “The government claims the situation has improved in Jammu and Kashmir. A G-20 meeting is being planned in May. Why the delay in conducting Assembly elections?” he said.
Announcing the outcome of the meeting, Dr Abdullah said a delegation of Jammu and Kashmir leaders will leave for Delhi and apprise all the national political parties about the prevailing situation. “Uncertainty prevails in Jammu and Kashmir after the Union government changed its status and took over all its affairs,” Dr Abdullah said. “We hope they will raise our issues appropriately in the upcoming Parliament session.”
Lashing at the media, the NC President said the media lacks the guts to broadcast the ground realities. “I know the situation is adverse right now and you too are forced to succumb before the circumstances,” he said.

The meeting hosted by Dr Farooq Abdullah at his Bathandi residence was attended by National Panthers Party leader Harshdev Singh, Congress chief Viqar Rasool Wani, Aam Aadmi Party (AAP) leader Taranjit Singh Tony, CPI(M) leader MY Tarigami, Shiv Sena president Manish Sahwany and Peoples Democratic Party (PDP) leader Amrik Singh Reen.

People’s Interest ‘Top Priority’, Doors Open For Dialogue: LG Sinha On Property Tax

SRINAGAR: While reiterating stand on recently imposed property tax in the Union Territory of Jammu and Kashmir, the Lieutenant Governor Manoj Sinha said “People’s interest is the top most priority of the government and has been duly taken care of”. He said the administration has issued a toll free number and people have been asked to put forth their suggestions if any as “doors are yet open for a dialogue”
Talking to media persons in Jammu, the Lieutenant Governor Sinha said “I do not speak on political issues. I reiterate that people’s concern is the top most priority of present dispensation. Their concerns have been well taken care of. The rate of tax in J&K is less than Ambala, Dehradun and Shimla”.
“There are 1,01,000 commercial properties in J&K out of which less than 40,000 are those who have to pay 700 rupees annually as property tax. Further there are 36,000 properties who have to pay 2000 rupees annually, which however is much less than states like Ambala, Dehradun and Shimla,” Sinha said.
“People’s concern is our priority. We have issued a toll free number to get feedback and suggestions from people, if any. Doors are yet open for dialogue,” LG Sinha said.
About uproar on APTECH Ltd. the LG Sinha said court has intervened into the matter who gave a verdict on yesterday. (KNS)
