    Germany to issue emergency visas to Turkey, Syria earthquake victims

    Berlin: Germany will grant three-month visas to Turkish and Syrian earthquake victims with family in the country, the interior minister said on Saturday.

    “This is emergency aid,” German Interior Minister Nancy Faeser told the daily newspaper Bild.

    “We want to allow Turkish or Syrian families in Germany to bring their close relatives from the disaster area to their homes without bureaucracy,” added Faeser.

    More than 28,000 people were killed in the devastating earthquake that rocked Turkey and Syria on Monday.

    It reached 28,192 on Saturday (local time), with Turkey’s death toll climbing to 24,617, Turkish Vice President Fuat Oktay said in a news conference.

    In Syria, the total number of confirmed deaths stands at 3,575, including 2,167 in rebel-held areas in the northwest, according to the White Helmets civil defense group.

    An additional 1,408 deaths have been recorded in government-controlled territories, according to Syrian state media, which cited the country’s health ministry.

    Faeser said that those eligible can have “regular visas, issued quickly and valid for three months”.

    She added that the joint initiative with the foreign ministry would allow victims to “find shelter and receive medical treatment” in Germany.

    Around 2.9 million people of Turkish origin live in Germany, with more than half holding Turkish nationality.

    President Recep Tayyip Erdogan on Tuesday announced a three-month state of emergency in the 10 provinces in southeastern Turkey impacted by the tremor.

    Earlier, Germany has also suspended rescue and relief work at the site of a deadly earthquake in Turkey due to security concerns, following a similar move by Austria earlier Saturday, reported CNN.

    The German Federal Agency for Technical Relief (THW) stopped its rescue operations due to a change in the security situation in the Hatay region, the organization said in a statement Saturday.

    It had been operating with International Search and Rescue (ISAR) Germany, in coordination with Turkey’s Disaster and Emergency Management Agency (AFAD).

    “In the last few hours, the security situation in the Hatay region has apparently changed. There are increasing reports of clashes between different groups. The search and rescue teams of ISAR Germany and THW will therefore remain in the joint base camp for the time being. ISAR and THW will resume their work as soon as AFAD deems the situation to be safe,” read the statement.

    The Austrian Army also cited security risks in suspending its operations, reported CNN.

    The Austrian Army has suspended rescue operations in Turkey due to an “increasingly difficult security situation,” according to the Austrian Forces Disaster Relief Unit (AFDRU).

    “The expected success of saving a life bears no reasonable relation to the security risk. There is increasing aggression between groups in Turkey,” Lieutenant Colonel Pierre Kugelweis of the AFDRU said in a statement Saturday.

    “There was no attack on us Austrians. We’re all fine … The mood among the helpers is good, given the circumstances … We would like to help, but the circumstances are what they are,” Kugelweis continued.

    “We keep our rescue and recovery forces ready. We are ready for further operations,” Kugelweis added, stating that a scheduled return to Austria for Thursday remains in place.

    New Delhi: The Congress asked the government on Saturday if it is prudent from a national security perspective for a firm facing serious accusations of money laundering to be allowed to dominate a strategic sector like ports.

    Congress general secretary Jairam Ramesh, in his series of “Hum Adanike Hain Kaun” questions to Prime Minister Narendra Modi, said these queries relate to industrialist Gautam Adani’s rapidly expanding monopoly in the ports sector.

    “Even though it is a Saturday here is HAHK (Hum Adanike Hain Kaun)-7. ‘Chuppi Todiye Pradhan Mantriji’,” Ramesh wrote on Twitter.

    He said the Adani Group controls 13 ports and terminals that represent 30 percent of India’s ports capacity and 40 percent of the total container volume. “It is no surprise that this growth trajectory has accelerated since 2014,” the former Union minister added.

    He said in addition to the Mundra port in Gujarat, recent acquisitions of the business group include the Dhamra port in Odisha (2015), the Kattupalli port in Tamil Nadu (2018), the Krishnapatnam (2020) and Gangavaram (2021) ports in Andhra Pradesh and the Dighi port in Maharashtra (2021).

    “There is a clear strategy at work: Gujarat, Andhra Pradesh and Odisha account for 93 percent of the overseas cargo traffic from India’s ‘non-major ports’. Krishnapatnam and Gangavaram are the largest private ports in the south. The Adani Group has declared its goal as expanding its market share to 40 percent by 2025 and is attempting to acquire even more ports.

    “Do you intend to oversee the takeover of every significant private port by your favourite business group or is there any space for other private firms that wish to invest?

    “Is it prudent from a national security perspective for a firm that faces serious accusations of money laundering and round-tripping by offshore shell companies to be permitted to dominate a strategic sector like ports,” the Congress leader asked.

    He alleged that as with airports, the BJP-led government has facilitated an Adani monopoly in the ports sector too, using all the means at its disposal.

    Alleging that ports that enjoy government concessions have been sold to the Adani Group without any bidding, and where bidding was allowed, the competitors “miraculously vanished” from the process, Ramesh said, “Income Tax raids appear to have helped ‘convince’ the previous owner of the Krishnapatnam port to sell it to the Adani Group.

    “Is it true that In 2021, the public sector Jawaharlal Nehru Port Trust was bidding for the Dighi port in Maharashtra in competition with Adani but was forced to withdraw its winning bid after the ministries of shipping and finance changed their mind about supporting its bid?” he asked.

    The Congress leader said generally, port concessions are negotiated with the special purpose vehicle for each port to segregate risks and protect assets, yet many of these ports are now part of a single listed entity — Adani Ports and SEZ.

    “Has this transfer of assets been done in violation of the Model Concession Agreement for ports? Have the concession agreements been changed to accommodate Adani’s commercial interests?” he asked.

    The Congress has been posing questions to the government on the Adani issue ever since a report of US-based short-selling firm Hindenburg Research levelled allegations of financial irregularities against the business group, leading to a meltdown of its stocks on exchanges.

    The opposition party has also been demanding a joint parliamentary committee probe into the issue.

    New Delhi: The Supreme Court on Friday referred the issue of the practice of excommunication in the Dawoodi Bohra community to a larger nine-judge bench which is seized of various aspects including the scope and extent of judicial review with regard to a religious practice.

    The nine-judge bench is slated to consider seven issues which were framed in February 2020 in the matter pertaining to review of the apex court’s 2018 judgement allowing women and girls of all ages to enter Kerala’s Sabarimala temple.

    A five-judge constitution bench headed by Justice S K Kaul, which dealt with the issue concerning the practice of excommunication in the Dawoodi Bohra community, said the plea deserves to be tagged with the review petition filed in the Sabarimala temple matter.

    The bench, also comprising justices Sanjiv Khanna, A S Oka, Vikram Nath and J K Maheshwari, directed the apex court registry to seek appropriate directions in this behalf from the Chief Justice.

    It said a 1962 verdict delivered by a five-judge constitution bench in the Sardar Syedna Taher Saifuddin Saheb vs The State of Bombay case which had ruled that the Bombay Prevention of Excommunication Act, 1949 violated Article 26 (b) (freedom to manage religious affairs) of the Constitution, requires reconsideration.

    “We have held that decision of the constitution bench (of 1962) requires reconsideration. We have recorded two grounds on which it requires reconsideration,” the bench said while pronouncing the order.

    On October 11 last year, the bench had reserved its order on whether to refer the plea on the issue to a larger bench for adjudication.

    It was considering if the Shiite Muslim community of a little over 10 lakh people spread across several countries has the right to excommunicate its dissenting members.

    While pronouncing the order on Friday, the bench said one of the issues is regarding balancing the rights under Article 26 (b) with that of Article 21 (protection of life and personal liberty) of the Constitution.

    It said issue involved in the matter is substantially covered by two of the questions which were framed for consideration by a nine-judge bench.

    “Whether the rights of a religious denomination under Article 26 of the Constitution of India are subject to other provisions of Part III of the Constitution of India apart from public order, morality and health?” reads one of the issues framed in February 2020 for consideration by a nine-judge bench.

    “What is the scope and extent of the word ‘morality’ under Articles 25 and 26 of the Constitution of India and whether it is meant to include Constitutional morality?” reads another issue framed in 2020 for consideration by the larger bench.

    A nine-judge bench in 2020 had made clear it was not hearing pleas seeking review of the 2018 judgement and would rather deal with larger issues, including the extent to which courts can intervene in “particular religious practices”.

    It had said it would only deal with the issues referred to it by a five-judge bench in the matter.

    Before that, in September 2018, the apex court in a 4:1 majority verdict lifted the ban that prevented women and girls between the age of 10 and 50 years from entering the famous Ayyappa shrine in Sabarimala and held that the centuries old Hindu religious practice was illegal and unconstitutional.

    While dealing with the issue of the Dawoodi Bohra community, the apex court was earlier told that The Bombay Prevention of Ex-communication Act, 1949 has been repealed and The Maharashtra Protection of People from Social Boycott (Prevention, Prohibition and Redressal) Act 2016 has come into force.

    Section 3 of the 2016 Act refers to 16 types of social boycott of a member of the community and section 4 says social boycott is prohibited and its commission shall be an offence. The 16 types of social boycott includes expulsion of a member of a community.

    According to the 2016 Act, a person convicted of the offence would be punished with imprisonment, which may extend to three years, or with fine which may extend to Rs 1 lakh or with both.

    In 1986, a petition was filed in the top court seeking reconsideration and overruling of the judgement delivered in 1962.

    New Delhi: Congress president Mallikarjun Kharge on Friday said his party will keep raising the Adani issue inside and outside Parliament and added that if the government does not work democratically, “people will get rid of it”.

    Addressing a press conference at the Congress headquarters here, Kharge posed a set of 10 questions to the government on various issues, including a controversy involving the business group headed by industrialist Gautam Adani and the expunging of certain remarks made by party leader Rahul Gandhi and him in Parliament.

    Alleging that the Adani “scam” is a huge one involving public money, he wondered why is the government reluctant to order a joint parliamentary committee (JPC) probe into it.

    Kharge said he had not said anything unparliamentary in his speech in the Rajya Sabha and only asked certain questions on the Adani issue.

    “Why is the Modi government not conducting a joint parliamentary committee probe into the allegations against the Adani Group? What is the reason behind (Prime Minister Narendra) Modiji and his government not even allowing (anyone) to raise the word Adani in Parliament?” he asked.

    “Why are the RBI, the SEBI, the ED, the SFIO, the corporate affairs ministry, the IT (department) and the CBI paralysed? So many scams have happened and why are they still silent? They only see other people but not him (Adani),” the Congress president alleged.

    “Modiji is now using our Parliament like a washing machine to wash the scams of his friend,” Kharge later alleged in a tweet in Hindi.

    He said it is the opposition’s job to ask questions of the government.

    The people of the country have elected parliamentarians and it is their responsibility to protect people’s money and rights and ask the government questions on the impact of scams on common people, he added.

    “But they did not agree to the (formation of a) JPC nor allowed us to raise the issue in Parliament and that is why our people are agitated.

    “We will keep asking questions of the government in parliamentary democracy. But the government does not want to allow Parliament to function democratically and is talking of autocracy. If the government is not ready to work democratically and talks of autocracy and dictatorship, people will get rid of it,” the leader of opposition in the Rajya Sabha said.

    “Shouldn’t the falling value of the LIC’s money, invested in Adani’s companies, be questioned? Shouldn’t questions be asked about the Rs 82,000-crore loan given to Adani by the SBI (State bank of India) and other banks? Shouldn’t questions be asked as to why Rs 525 crore of the LIC and the SBI were invested in Adani’s FPO, despite a more-than-32-per cent fall in Adani’s shares? Shouldn’t questions be asked as to why the value of the LIC’s and SBI’s shares fell by more than Rs 1 lakh crore in the stock market?” Kharge asked.

    “Is it a fact that France’s Total Gas has stopped its USD 50 billion investment in Adani’s company, pending the completion of an investigation against Adani? Has the world’s largest equity investor, Norway Sovereign Fund, sold all Adani shares worth USD 200 million?

    “Has the MSCI downgraded the ranking of Adani’s companies? Have Standard Chartered, City Group, Credit Suisse stopped lending against Adani’s dollar bonds? Has Dow Jones removed Adani’s companies from the ‘Sustainability Indices’?” he asked.

    “What is the reason that Modiji and his entire government do not allow even the utterance of the word Adani in Parliament?” Kharge asked, adding that the country demands answers to these questions.

    The Congress chief said he has written to the Rajya Sabha chairman over the expunging of his remarks. By merely expunging his remarks, the allegations made by people and the media will not be cleared, he added.

    On his remarks in the Rajya Sabha and that of Gandhi in the Lok Sabha being expunged, Kharge said, “You can well imagine what is going on in the name of democracy.”

    He said he was the floor leader in the Lok Sabha for five years and the leader and the deputy leader in the Karnataka Assembly, but had never seen verses or words like “washing machine” being expunged.

    “The entire opposition is together on the demand for a joint parliamentary committee probe into the Adani issue. There is unity on this and everyone wants to save the country and protect poor people’s wealth,” he said.

    Asked about the Rajya Sabha chairman’s role, Kharge said, “I don’t want to say anything, you have seen it for yourself…. If I say something, they will say I am raising questions on the chairman…. I have great respect for him. We want parliamentary democracy and that is why we are moving with sensitivity.”

    Congress leader Jairam Ramesh also alleged that “Parliament TV blacks out whatever Opposition demands and does”.

    “Yesterday, Chairman of the Rajya Sabha chided the Leader of Opposition for not elevating level of the debate. He is of course silent at the way the Jagadguru of Jhoot debased it completely with cheap personal swipes at his opponents. Chanting ModiChalisa does not elevate debates,” the former Union minister wrote on Twitter.

    Adani Group stocks have taken a beating on the bourses after US-based short-selling firm Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate.

    The Adani Group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.

    New Delhi: The Congress on Monday questioned the “deafening” silence of Prime Minister Narendra Modi on the Adani issue and made a pun on his monthly ‘Mann ki Baat’ asking him whether it was an instance of ‘Mann ki banking’ to benefit his cronies.

    “His silence is not just eloquent but also deafening. Break the silence, Mr. PM,” said AICC general secretary of communications Jairam Ramesh while posing him a set of three questions.

    The Congress said it will pose three questions to the Prime Minister every day starting Sunday.

    “Dear PM Modi, As promised yesterday, here is today’s set of three questions for you, HAHK (Hum Adani Ke Hain Kaun)-2? So to speak,” he said.

    The Congress leader alleged that the government has a track record of “bailing out” failing disinvestments such as IDBI Bank, New India Assurance, and General Insurance Corporation using LIC funds.

    “It’s one thing to bail out public sector companies and quite another to use the savings of 30 crore loyal policy-holders to enrich your friends. How did LIC make such a heavy allocation to the risky Adani Group that even private fund managers had steered clear of? Is it not the duty of the government to ensure that vital public sector financial institutions are more conservative in their investments than their private sector counterparts,” he asked.

    Srinagar, Feb 06: Stating that the ongoing demolition drive going on across J&K has triggered a wave of frustration and chaos among people, National Conference vice-president Omar Abdullah Monday advocated that the government should make the bulldozer its last resort, give people a chance to prove their claim and issue proper notices to the people having illegal possession of State land. He was quick to add that the National Conference was not against those who have grabbed State land but “a proper procedure should be followed.”

    “In J&K, there is chaos everywhere. Bulldozers are being sent everywhere to demolish houses, complexes and buildings. But nobody knows what is the procedure and on what basis this demolition drive is being conducted,” said Omar while addressing a press conference in Srinagar, as per news agency—Kashmir News Observer (KNO). He said his sister approached the High Court with regard to the proposed demolition of the Gupkar house of Omar and was told by the government before the Court that the list making rounds in the media are “forged.” “Given the government response in the court, I urge the government to make the genuine list of people who have grabbed State land public,” he said.

    Omar suggested a slew of measures to the government with regard to the demolition drive. “No government is supposed to bring trouble for the people. Bulldozers should be the last resort. The Government must issue proper notices to those who, according to it, have grabbed State land and given them at least six weeks’ time to prove their claim on land under them and show the documents,” he said. “In our case, my sister produced the documents before the HC that states that the lease of Gupkar house is still active and has some years to expire. Likewise, people should be given time to present the documents and let the revenue team verify the same. If after proper verification land under anybody is found under illegitimate possession, then a bulldozer can be used for sure.”

    Omar said that the government should also make a public “genuine list of people who have occupied State land.” “It seems that the ongoing drive is aimed at creating a wedge between communities. This drive lacks proper procedure,” he said.

    He said in the case of demolition of NC leader Ali Muhammad Sagar, he found that no notice was served. “There is a procedure that if the person doesn’t receive the notice, the same is fixed on the front portion of the gate. Nowhere this is being done,” he said, adding, “Officials accompanying bulldozer at Nedous, told my relatives that they had pressure from the top and have to do something to show their bosses.”

    Omar said in many areas the ongoing demolition-cum-eviction drive is becoming a “hub of corruption.” “I got many calls from several areas with people saying that they are being told to pay Rs 1 or 1.5 lakh to get their names removed from the list,” he said.

    He said that NC MPs will try to raise the issue in the Parliament if they are given time to speak.

    To a query that whey NC would approach the court on the issue, Omar said that he has suggested some measures to the government and that if the J&K administration fails to give positive response, they would surely consult lawyers and discuss the future course—(KNO)

    New Delhi: Opposition parties will stage a demonstration on Monday outside the Parliament House to demand a probe by a Joint Parliamentary Committee (JPC) into the allegations of fraud and stock manipulation against the Adani Group, souces said.

    Sources said that before the demonstration, the Opposition parties led by Congress will meet at 9.30 a.m. to finalise a strategy for the day in Parliament.

    On Friday, both houses of the Parliament were adjourned amid sloganeering by Opposition parties to seek discussion on the issue.

    Parliamentary Affairs Minister Pralhad Joshi on Friday said that the government has nothing to do with the matter and the Opposition is raising it as it is bereft of issues.

    “Government has nothing to do with it (Adani group issue)… The Opposition is disrupting the house as it has no other issues,” the Parliamentary Affairs minister said.

    Srinagar: Peoples Democratic Party (PDP) president Mehbooba Mufti on Sunday said former president Pervez Musharraf was the only Pakistani General who genuinely tried to address the Kashmir issue.

    Musharraf, 79, passed away on Sunday at a Dubai hospital.

    “Deepest condolences. Perhaps the only Pakistani General who genuinely tried to address the Kashmir issue. He wanted a solution according to the wishes of the people of J-K and acceptable to India and Pak. Though GOI has reversed all CBMs initiated by him and Vajpayee ji, the ceasefire remains,” the former Jammu and Kashmir chief minister wrote on Twitter.

    Musharraf seized power in 1999 in a coup and served as Pakistani president from 2001-2008.

    Former Pakistan foreign minister Khurshid Mahmud Kasuri had claimed in his book ‘Neither A Hawk Nor A Dove’ that India and Pakistan were close to finding a solution to the vexed Kashmir issue during the 2001 Agra Summit between the then prime minister Atal Bihari Vajpayee and Musharraf.

    Morbi: The state Urban Development Department has issued a fresh notice to the Morbi Nagar Palika, asking it to explain why it should not be superseded.

    The nagar palika members have decided to reply to the notice latest by Wednesday.

    Former president of the Morbi Nagar Palika and present chairman of the Public Welfare Department Committee, Devabhai Avadia told IANS, “On Saturday, nagar palika received 47 pages SIT report sent by the state urban development, and has asked that now you have documents related to the suspension bridge collapse case, give a detailed explanation why the nagar palika should not be superseded? Either individual members or only the president or more than one member may submit the explanation by Wednesday.”

    “Last time, when the urban development had issued a notice, the nagar palika general board had passed a resolution stating that in absence of documents related to the suspension bridge, it can’t reply,” he said.

    The state government had constituted a Special Investigation Team (SIT) headed by the Deputy Superintendent of Police to investigate the collapse of the suspension bridge on the Machchhu river on October 30 in which 132 persons, including 35 children, were killed.

    In this connection, the state government has stated before the High Court that it will supersede Morbi Nagar Palika after holding it responsible for the bridge collapse. In a follow-up to this submission, the state has initiated the process of superseding the nagar palika.

    New Delhi: The Congress on Sunday said that it will ask three questions a day related to Adani issue to the Prime Minister. The Congress said that after Panama Papers leak no action was taken despite assurance from the Prime Minister.

    Congress Communication In-charge Jairam Ramesh said on Sunday, “Amid the allegations against the Adani Group, the Modi government has maintained a loud silence which smacks of collusion. Starting today, the Congress party will pose three questions a day to the Prime Minister.”

    Raising a question before the Prime Minister, Ramesh alleged, “In response to the Panama Papers expose on 4 April 2016, the Ministry of Finance announced that you had personally directed a multi-agency investigative group to monitor financial flows to and from offshore tax havens. Subsequently, at the G20 summit in Hangzhou, China on 5 September 2016, you stated: ‘We need to act to eliminate safe havens for economic offenders, track down and unconditionally extradite money launderers and break down the web of complex international regulations and excessive banking secrecy that hide the corrupt and their deeds.’ This leads to some questions that you and your government cannot hide from saying “HAHK (Hum Adani Ke Hain Kaun).”

    “Vinod Adani, the brother of Gautam Adani, was named in the Panama Papers and the Pandora Papers as someone who operates offshore entities in the Bahamas and the British Virgin Islands. He is alleged to have engaged in ‘brazen stock manipulation’ and ‘accounting fraud’ via ‘a vast labyrinth of offshore shell entities’. You have spoken often about your sincerity and ‘niyat’ in fighting corruption and even subjected the nation to the heavy costs of demonetisation.

    The Congress leader said, “Over the years you have misused agencies like the Enforcement Directorate, Central Bureau of Investigation and the Directorate of Revenue Intelligence to intimidate your political opponents and to punish business houses that do not fall in line with your cronies’ financial interests.

    “What action has been taken, if ever, to investigate the serious allegations made over the years against the Adani Group? Is there any hope of a fair and impartial investigation under you?” he said

    “How is it possible that one of India’s largest business groups, one that has been allowed to build monopolies in airports and seaports, could have escaped serious scrutiny for so long despite persistent allegations? Other business groups have been harassed and raided for much less. Was the Adani Group essential to a dispensation that has profited from ‘anti-corruption’ rhetoric all of these years?” he asked.
