    New Delhi: Delhi BJP chief Virendra Sachdeva has sought action against Manish Sisodia claiming that a “massive rigging took place in recruitment of guest teachers by the Delhi Education department”.

    Sachdeva urged Lt. Governor Vinai Kumar Saxena to seek a report from the Education Department on the “massive rigging” and to give orders for action against Sisodia, who was the Education Minister, and departmental officials.

    “The Kejriwal government has misused the OBC quota in guest teacher recruitment to recruit AAP party workers, and educational qualifications were relaxed in hundreds of cases,” the BJP leader alleged.

    Sachdeva also claimed that the Kejriwal government, by “putting pressure on the officials, appointed many teachers from the general category and other castes as a guest teacher under OBC quota”.

    “Many guest teachers were given subject exemption, for example a teacher who had done post graduation in Environmental Science but was assigned to teach Biology. Similarly, a post graduate in Home Science was engaged in teaching English,” he claimed.

    Sachdeva asserted that the Kejriwal government “talks about education revolution, but it does education scams”.

    Kolkata: The Calcutta High Court on Saturday cleared the decks for the Enforcement Directorate (ED) to take Trinamool Congress leader Anubrata Mondal to Delhi in connection with the multi-crore cattle smuggling scam in West Bengal.

    The single-judge bench of Justice Bibek Chaudhuri said a fine of Rs 1,00,000 was also imposed as a penalty on Mondal for keeping the multiple court option open in the matter by filing the same petition at both Calcutta High Court and Delhi High Court by suppressing information in both these courts.

    On Saturday, Mondal’s counsel told the court that his client should not be taken to Delhi considering his health.

    In reply, the ED counsel said that in that case, Mondal will be taken to the national capital through a flight and also get him treated at the AIIMS there.

    After hearing both sides, Justice Chaudhuri permitted the ED to take Mondal to Delhi on a flight.

    But before taking him to Delhi, as per the order, Mondal has to be examined at a central hospital and a certificate declaring him fit for travel has to be issued by that central hospital before taking him to Delhi.

    On Saturday, the ED counsel specially stressed on Mondal’s attempts to keep the multiple court options open in the matter.

    “Is it not because of a backup in case the verdict of a particular court does not go in favour of him, in this case he filed the same petition at Calcutta High Court and Delhi High Court. On Friday, his counsel informed the Delhi court that his client will withdraw the petition made by him on this count at Delhi High Court. Anubrata Mondal lacks all ethical values. He deserves a huge financial penalty for that,” the ED counsel said.

    New Delhi: A Delhi court has granted bail to a man accused of murder during the 2020 North East Delhi riots, saying in the name of opposing the bail plea the prosecution tried to mislead the court as eyewitnesses did not establish his culpability.

    The court also asked the Commissioner of Police Sanjay Arora to sensitise all Investigating Officers (IOs) about their duty towards assisting the court in a fair manner.

    Additional Sessions Judge Pulastya Pramachala was hearing the bail plea of Rishabh Chaudhary in a case of rioting and alleged murder of a man called Mushraff, whose body was found in a drain near Johripur Pulia in Gokalpuri on February 27, 2020.

    According to the postmortem report, there were 12 external injuries on the body and the cause of death was injuries to the brain produced by blunt force impact.

    “…Cited eyewitnesses have been examined, but they did not establish the incident in question and the other two remaining witnesses did not claim having seen any person in the mob I find the applicant to be entitled to bail,” the judge said in an order passed on Friday.

    “Hence, the bail application is allowed and applicant Rishabh Chaudhary is admitted to bail on his furnishing personal bond and surety bond in the sum of Rs 30,000 each with one surety in the like amount,” the judge added.

    The judge said the statement of an eyewitness before the Investigating Officer (IO) identifying the accused had no evidentiary value and that the same witness in his testimony before the court categorically stated he had not identified anyone in the riotous mob.

    But the IO’s reply did not mention the witness’ statement before the court, the judge said.

    “It is well within the knowledge of the Special Public Prosecutor (SPP) and IO that statement under section 161 (examination of witnesses by police) of the code of criminal procedure (CrPC) cannot stand before the testimony given before the court and hence, the purpose of not mentioning the testimony of this witness given before the court appears to be nothing but to mislead this court ,” the judge said.

    The judge noted the submissions of the SPP that one of the prosecution witnesses had identified Chaudhary as a member of the riotous mob and that the IO had mentioned him in the reply.

    But in his testimony before the court, the other alleged eyewitness did not say anything about the incident which allegedly occurred on February 25 from around 7.30 pm to 8 pm, and which was being probed in the present case, the judge said.

    “Thus, I find that in the name of opposing bail application through a reply the prosecution has attempted to mislead the court rather than assisting in a fair manner to project the correct picture of the developments taking place in the case,” the judge said.

    He said any reply being filed by the IO or prosecution must be with the objective to assist the court and it was imperative to have a fair and transparent reporting of the facts.

    “If the reply is filed in a jealous manner, thereby suppressing the material facts, it cannot be said to be assistance to the court. Hence, I find that there is a requirement to sensitise all the IOs in respect of their duty towards the court, so as to assist in a fair manner, rather than adopting the practice of hide and seek,” the judge said.

    “Hence, once again I call upon the Commissioner of Police to do the needful for proper sensitisation of all the IOs in this respect,” the judge added.

    The Gokalpuri police station had registered an FIR against 12 accused, including Chaudhary for various offences under the Indian Penal Code, including rioting, murder, criminal conspiracy and kidnapping or abducting in order to murder.

    The other accused in the case are Lokesh Kumar Solanki, Pankaj Sharma, Sumit Chaudhary, Ankit Chaudhary, Prince, Jatin Sharma, Vivek Panchal, Himanshu Thakur, Sahil, Sandeep and Tinku Arora.

    In his bail plea, Chaudhary said he was arrested on the basis of the disclosure statement of the main accused Solanki but no recovery was effected from his possession and he was never related to Kattar Hindu Ekta’ WhatsApp group, directly or indirectly.

    Chaudhary’s counsel said the applicant is a student of graduation aged 22 years and no fruitful purpose would be served by keeping him in jail.

    The name of the WhatsApp group had surfaced in a supplementary charge sheet filed by the Delhi Police against nine accused, including Chaudhary, for the alleged murder of a man named Hashim Ali during the riots.

    According to the charge sheet, ‘Kattar Hindu Ekta’ group was created on February 25. Its alleged aim was to exact revenge for the troubles faced by Hindus and promote enmity between different groups on the ground of religion. It allegedly acted in a way which was prejudicial to maintenance of harmony.

    In the excerpts from the chats exchanged by the group filed in the charge sheet dated September 26, 2020, one of the members claimed RSS (Rashtriya Swayamsevak Sangh) activists had come to support them.

    Communal clashes had broken out in North East Delhi on February 24 between the supporters and opponents of the new citizenship law. The violence soon spiralled out of control leaving at least 53 people dead and around 200 injured.

    New Delhi: A Delhi court on Saturday reserved its order on a plea by the CBI seeking further three-day custody of former Delhi deputy chief minister Manish Sisodia, arrested in a corruption case related to the excise policy.

    CBI’s plea was opposed by Sisodia’s lawyer who said the inefficiency of the agency to complete its probe cannot be a ground for remand and he cannot be asked to incriminate himself.

    Sisodia, who was produced before special judge M K Nagpal, said non-cooperation cannot be a ground for custody and opposed the CBI’s plea for his remand.

    There was heavy security presence in and outside the Rouse Avenue Courts premises.

    The supporters of the Aam Aadmi Party staged a protest outside the premises and raised slogans.

    Sisodia was granted five-day CBI custody on Monday. The CBI on Sunday evening had arrested Sisodia in connection with alleged corruption in the formulation and implementation of the now-scrapped liquor policy for 2021-22.

    New Delhi: A Delhi Transport Corporation (DTC) bus on Saturday ran into the compound wall of christian cemetery at Delhi’s Prithviraj Road area and damaged the wall and graves, the police said.

    The incident occurred on Saturday morning at 6:50 am, police said.

    So far, no casualty or injury to anyone has been reported in the incident, police said.

    The exact reason behind the accident was not clear.

    New Delhi: The former Delhi Deputy Chief Minister Manish Sisodia, who was arrested by the Central Bureau of Investigation (CBI) in connection with the Delhi excise policy scam, will be produced before the Rouse Avenue District Court after the expiry of his custodial remand, sources said.

    The source said that Sisodia will be produced by 2 p.m. on Saturday.

    The sources have also claimed that they would further seek the custodial remand of Sisodia.

    The CBI sources have claimed that the former Aam Aadmi Party Minister was still evasive and was not cooperating.

    The central probe agency sources said that in January they seized a computer from the office of Sisodia. Later, it was learnt that files and other data were deleted from the computer. The CBI then sent the computer to Forensic Science Laboratory (FSL) to retrieve the deleted files. Now the FSL has given them a report and retrieved the whole file deleted from the computer.

    Apart from this, Sisodia was also confronted with the statement of an IAS official, who turned approver against him and got his statement recorded under section 164 of the CrPC.

    A day after his arrest Sisodia resigned from his post. Satyendar Jain, who is currently in jail and was holding the Delhi Health Minister’s post also resigned along with him.

    The CBI has alleged in the remand paper that Sisodia played a crucial role in the Delhi excise policy scam.

    “The report of the expert committee in connection with excise policy was changed by Sisodia only to benefit a few liquor businessmen. This was also done as through accused Vijay Nair, they had collected Rs 100 crore from South Group being controlled by South India-based liquor businessmen and politician. They would be more benefited through the policy.”

    “Payment of Rs 100 crore was done through hawala channel, which we have traced. We have learnt that between September and October 2021, Sisodia changed around 14 cellphones and four SIM cards. The purpose of changing the cell phone was nothing but to destroy the evidence. Devender Sharma, the secretary of Sisodia, had provided all these mobile phones, we have his statement in this respect,” said the source.

    The CBI has already filed a charge-sheet against seven persons and they are all set to file a supplementary charge-sheet in the case.

    SRINAGAR: The Delhi High Court on Friday directed the Passport Authority in Srinagar to take a fresh decision on the request for the issuance of a passport to former JK chief minister and Peoples Democratic Party (PDP) president Mehbooba Mufti within three months.

    The submission was made before a single-judge bench of Justice Prathiba M Singh, wherein the Central government’s standing counsel, Kirtiman Singh, told the court that a decision was taken yesterday on Mufti’s appeal and the matter has been remanded to the passport office in Srinagar.

    Justice Prathiba M Singh noted that the issue has been pending for two years following an appeal against the rejection; it has now been remanded to the passport officer concerned for reconsideration.

    “Considering that the matter has been remanded to the passport officer and the initial rejection was almost two years ago, let the concerned passport officer take a decision expeditiously within three months. The petition is disposed of,” the court ordered.

    Notably, the court order came on a petition by Mufti seeking a direction to the authorities to take an early decision on her appeal regarding the issuance of travel documents.

    In her plea, the former Jammu & Kashmir chief minister stated that there was considerable delay in issuing a new passport to her despite reminders.

    It is pertinent to mention that former chief minister Mehbooba Mufti’s passport expired on May 31, 2019, after which she applied for a fresh/ renewal of her passport on December 11, 2020. However, she was denied the renewal after which she approached the High Court of Jammu & Kashmir and Ladakh.

    In 2021, a single bench of the HC dismissed her petition, and in April same year she moved and appealed before the division bench of the high court which granted her the liberty to approach the appropriate authority to avail the proper remedy available to her.

    “On receipt of the appeal, the authority concerned shall consider and decide the same on its merits, strictly under rules, regulations, and the provisions of the Act, that too un-influenced by the observations made in the judgment impugned dated 29th of March, 2021,” the court said—(KNO)

    New Delhi: An Uber auto-rickshaw driver has been arrested for sexually harassing a journalist during a ride from her residence to her friend’s place in south Delhi, police said on Friday.

    The accused was identified as Vinod Kumar Yadav, 24, a resident of Noida’s Sector 123 and native of Bihar’s Madhubani.

    The incident occurred on Wednesday and the journalist also shared the video of the incident on social media.

    According to police, on March 2, at about 11.00 pm,, the journalist, a resident of Bharat Nagar, approached New Friends Colony police station and filed a complaint against a TSR (auto-rickshaw) driver.

    “She levelled allegations of indecent behaviour as well as lascivious staring by him, while she was travelling from New Friends Colony to Malviya Nagar on March 1 about 4.40 p.m.. Accordingly, a case under relevant sections of IPC was registered and investigation taken up,” said a senior police official.

    “The ownership of the auto-rickshaw was procured which was found in the name of Mohd Yunus Khan, a resident of Nehru Camp, Govindpuri. Yunus was questioned and it came to light that the TSR was already purchased by Vinod,” said the official.

    “Meanwhile technical surveillance was also applied and Vinod was detained and interrogated and he was confirmed to be the alleged and hence arrested. All legal formalities including statement under section 164 Code of Criminal Procedure was completed,” said the official, adding that further investigation is in progress.

    Earlier, Delhi Commission for Women (DCW) Chairperson Swati Maliwal has also issued notice to Uber India and Delhi Police over the incident.

    “Notice has been issued to Uber India and Delhi Police over the unfortunate incident of molestation of a female journalist in an Uber Auto in Delhi,” Maliwal tweeted.

    Narrating her ordeal on Twitter, the woman journalist said that when she boarded an auto-rickshaw from her residence in New Friends Colony to Malviya Nagar to visit her friend, the driver, identified as Vinod Kumar, started staring at her inappropriately through the side mirrors of the auto, “precisely at her breasts”.

    “I took an auto from my home to a friend’s place. After a while, I noticed that the driver was looking at me through the side mirrors of the auto, precisely at my breasts. I shifted a bit towards the right and wasn’t visible in the left side mirror,” she said.

    “He then started looking into the right side of the mirror. I then shifted to the extreme left and wasn’t visible in any of the mirrors. He then started looking back again and again to see me. I first tried using the safety feature of @uber, but to no avail”.

    “The first time I dialled the number, the audio wasn’t clear. I then confronted him and said that I would raise a complaint. I even asked him to focus on driving. To this, he said, “kardo” (do it) and I then redialed the number but couldn’t hear the audio due to poor network”.

    New Delhi: The Delhi High Court on Friday rejected a plea against Sujan R. Chinoy’s appointment as the Director General of Manohar Parrikar Institute for Defence Studies and Analyses (MP-IDSA) in January 2019.

    A division bench of Chief Justice Satish Chandra Sharma and Subramonium Prasad was hearing lawyer petitioner Subhash Chandran K.R.’s Public Interest Litigation (PIL) contending that it concerns a prominent post in defence for which no advertisement was published.

    The bench said that since it relates to a service matter, it cannot be maintained and no case for interference can be made out.

    “In the considered opinion of this court, as the present PIL is in relation to a service matter, no case is made out for interference in the matter. Admission is declined,” it said.

    Solicitor General Tushar Mehta has said that this appointment is made by a committee consisting of the Cabinet Secretary, the Defence Secretary, and two persons of eminence and the “petitioner has no connection. He is a stranger”.

    Noting that there is no advertisement for a lot of high offices, the bench dismissed the PIL.

    The PIL claimed that the institute did not obey to the rules for a public appointment which was “an act of lawlessness cutting at the very root of the strict mandate of Articles 14 and 16 of the Constitution”.

    New Delhi: The All India Institute of Medical Sciences (AIIMS) will partner with other government hospitals in the national capital for referral of patients to optimally utilise vacant beds in other hospitals, it was announced on Friday.

    Lt Governor V.K. Saxena held a meeting with AIIMS Director Dr. M Srinivas, Chief Secretary Naresh Kumar and other officials to evolve a formal system for referral of patients. As the premier health organisation AIIMS always suffer acute shortage of beds, the pact will optimally utilise vacant beds in other government hospitals where critical but stable patients from AIIMS could be referred for further treatment.

    The new system will also ensure that patients who require primary and secondary healthcare services go to the other hospitals and chronic and critically ill patients get specialied treatment at the AIIMS.

    Under the pilot project, the Indira Gandhi Hospital in Dwarka and NDMC’s Charak Palika Hospital will be taken on-board and paired with the AIIMS starting next month.

    The AIIMS will support these hospitals in terms of expertise and critical infrastructure and patients from the AIIMS could be referred to these hospitals in case of unavailability of beds. Gradually, other government hospitals and healthcare centres will be roped in and developed as ‘Partner Institutions’ of AIIMS, to cater to the local population in different localities of Delhi.

    The aim is to develop super-specialty hospitals in different localities of the capital so that the burden on AIIMS could reduce and simultaneously people across the city could access healthcare near their homes at par with what they would have got at the AIIMS.

    The LG has directed the Health Department to carry out a gap analysis of available beds in all its major hospitals within a week. It was also directed to develop a centralised dashboard where the availability of beds in all government hospitals in the city will be available on a real time basis.
