    New Delhi: Hearing petitions alleging police atrocities on students inside the Jamia Millia Islamia (JMI) University here following anti-CAA protests in December 2019, the Delhi High Court on Monday said excessive use of force cannot be justified and the authorities concerned are accountable for their conduct.

    Representing some of the petitioners in the matter, senior advocate Indira Jaising argued that the force used by police in the present instance was “wholly unproportional to alleged public good” and thus, urged the court to form a fact-finding committee comprising former judges to ascertain the “authentic” events for granting further relief.

    A bench headed by Justice Siddharth Mridul was, however, told by the Delhi Police’s counsel that the National Human Rights Commission (NHRC) has already prepared a report on this aspect.

    The bench, also comprising Justice Talwant Singh, directed that the NHRC report be given to the petitioners within four weeks and said there is “enough jurisprudence” on the issue of excessive use of force by police in the country.

    “Excessive use of force cannot be justified at all. They (police officials) are accountable. These authorities are accountable for the excessive use of force. That is why you (petitioners) are here,” the court said.

    Jaising said there was no last-mile implementation of the court’s decisions while clarifying that the NHRC report did not put an end to the relief sought in her plea.

    “Please take a look at that report,” the court told the senior lawyer.

    In her submissions, Jaising contended that there was “extreme form of violence” by police officials inside the Jamia campus, even after a threat to law and order was diluted when the protesting students returned to the university and the city police had no “backing of law” or permission from the vice-chancellor to enter the campus.

    The police personnel trespassed and can be seen beating up students brutally and since there is no authentic fact finding in relation to the incident, the court may appoint a committee for the purpose, she said.

    In another matter, the court granted time to the petitioner, represented by senior advocate Salman Khurshid, to file written submissions with respect to his prayer seeking guidelines on use of force and peaceful protests in universities.

    In relation to the December 2019 incident, several petitions are pending before the court, seeking directions for setting up a special investigation team (SIT), a commission of inquiry (CoI) or a fact-finding committee, medical treatment, compensation and interim protection from arrest for the students and registration of FIRs against the erring police officers.

    The petitioners are lawyers, Jamia students, residents of Okhla in south Delhi where the university is located and the imam of the Jama Masjid located opposite the Parliament House.

    During the course of the hearing, the court questioned if the petitioners can directly seek action and FIRs against the allegedly erring police officials, without first making a complaint.

    Senior advocate Colin Gonsalves, appearing in the matter for some of the petitioners, said the high court can decide the matter directly since it is public interest litigation (PIL) and the parties need not be “directly affected”.

    Another counsel argued that there is medical evidence to show the injuries sustained by the students and the court can interfere in cases of violation of fundamental rights.

    The petitioners had earlier said in the present case, there was a need for an SIT, which would be independent of police and the Centre, which by their conduct have shown that their investigation into the violence was “not independent”.

    They had said such a move would “reassure the public” and restore the people’s faith in the system.

    Some petitioners have also filed amendment applications for adding new prayers to the existing pleas, such as to set up an SIT and transfer the FIRs lodged against the students to an independent agency.

    The Delhi Police has opposed the petitions and said the reliefs sought by the petitioners cannot be granted as chargesheets have been filed in connection with the violence cases and they should have sought whatever relief they wanted before the subordinate court.

    It has opposed the setting up of an SIT to inquire into the alleged police atrocities as well as transferring the FIRs lodged against the students to an independent agency, and argued that a “stranger” cannot seek a judicial enquiry or investigation by a third-party agency.

    The city police has said PIL petitioners cannot be allowed to choose the members of an SIT for investigating and prosecuting any alleged offence.

    It has asserted that in the garb of student agitation, there was a well-planned and orchestrated attempt by some people with local support to intentionally perpetrate violence in the area and subsequently, comprehensive investigation was carried out by the Crime Branch of the Delhi Police in several FIRs.

    The matter would be heard next on May 8.

    On October 19, 2022, the Supreme Court had requested the high court to “hear out early” the petitions concerning the incidents of violence during the protests against the Citizenship (Amendment) Act (CAA), while noting that “these matters are pending before the high court for some time now”.

    New Delhi: Education Minister Atishi on Sunday launched a 36-episode video series on the Delhi government’s Happiness Curriculum and said it will enable educators across the world help their students learn to live a happy and purposeful life.

    Through this initiative, people will learn to serve humanity in the truest sense, she said.

    The Happiness Curriculum was launched in 2018 with a vision to strengthen the foundation of happiness and well-being of students through a 35-minute class conducted every day from kindergarten to Class 8 across 1,030 government schools in the national capital.

    Development of self-awareness, expression, empathy and understanding of relationships are the key objectives of the curriculum.

    “The video series is available with subtitles which will help the Delhi government spread the philosophy of the Happiness Curriculum to a larger public. This is a very significant initiative through which we can bring positive changes in our lives,” Atishi said.

    The series by the Delhi government’s Education Department is an initiative to share the “purpose of life” and the role of education in achieving that purpose, she said.

    The department will also share this video series with top universities and institutions across the world and incorporate their suggestions, the minister said.

    New Delhi: The Motor Accident Claims Tribunal (MACT) has directed the Delhi Police to enquire and register an FIR against a litigant for placing on record a fake court order to claim Rs 23.50 lakh as compensation.

    The tribunal’s Presiding Officer, Ekta Gauba Mann, said that an attempt by litigant Pooja to wrongfully claim the compensation awarded to the petitioner in another case is a very serious issue.

    “Pooja has prepared a fake order of this court by getting it fabricated by mentioning in place of Pushpa Rajwar v. Nawab Ali as Pooja v. The State & ors. and by mentioning in place of the name of this court the wrong name of the court,” the judge said.

    “It is a very serious issue as this court is dealing with the award of compensation. By moving the present application, Pooja, on the basis of said alleged fake order, is attempting to get the award of Rs 23.50 lakh, i.e. the award amount which was awarded to the petitioner /victim in case titled Pushpa Rajwar v. Nawab Ali,” the judge said.

    “So, the Station House Officer of Prashant Vihar police station is directed to inquire and then to register the FIR as to how come the fake copy of order in the name of this court has been placed on record by the applicant Pooja for wrongfully claiming the compensation of award amount which has been awarded to the actual victims of MACT case titled Pushpa Rajwar v. Nawab Ali,” the judge said.

    The matter has been posted for further hearing after receiving the SHO’s report on March 14.

    The counsel for Pooja told the court that he was not aware she had prepared any fake order of this court.

    He sought permission to withdraw his vakalatnama, which was permitted by the court.

    Jammu, Mar 11: Ahead of resumption of parliament session, Member Parliament and president National Conference, Farooq Abdhulla on Saturday said that a delegation of Jammu and Kashmir’s opposition parties will leave for national Capital Delhi and apprise all national political parties about the situation in the Union Territory.

    Addressing a press conference at his Jammu residence, Dr Abdullah, as per news agency—Kashmir News Observer (KNO), that uncertainty prevails in Jammu and Kashmir after union government changed its status and took over all its affairs.

    He said the delegation of Jammu and Kashmir will apprise national leadership about the ground situation in J&K and uncalled delay in starting the democratic process.

    “After day-long deliberations with all opposition parties we decided to leave for Delhi and call all national leaders to apprise them about the condition of Jammu and Kashmir,” Dr Abdhullah said, adding, “The delegation will also meet Election Commission of India over the delay in conducting the elections.”

    He further added that on one had Prime Minister and all sections of Government of India claimed that situation has improved in the Jammu and Kashmir, while in May G20 meetings also planned in the UT. “So, we don’t understand the delay in conducting the assembly elections,” the NC chief said.

    Dr Abdullah added that JK delegation apprised the national leadership about issues like land eviction drive, recruitment scams, imposition of taxes so they understand “our issue and raise it appropriately in upcoming parliament session”.

    Dr Abdhullah was flanked by former minster and National Panther’s Party Leader, Harshdev Singh, JK Congress Chief Viqar Rasool Wani, former Minister and Congress Vice President Raman Bhalla, DDC member and AAP leader Taranjit Singh Tony, former MLA M Y Taragami and others, JK Shiv Sena President Manish Sahwany, PDP leader Amrik Singh Reen

    “Property tax or any another tax is the right of assembly not the bureaucratic rules. Government should conduct elections and also respectfully return our statehood. This is a temporary arrangement and permanent arrangement is assembly, that why we are saying restore assembly let people decide about tax,” he added.

    Dr Abdullah said that we will discuss the issue of unemployment, compulsion of conducting recruitment to blacklisted company, property tax and others.

    On invitation to DPAP president Gulam Nabi Azad, Dr Abdhulla sad that he yet not be invited but doors has been opened for all.

    It is worthy to mention that Parliament’s Budget Session was commenced in January. It observed recess from February 14 till March 12 to enable the department related Parliamentary Standing Committees to examine the Demands for Grants and make reports relating to their Ministries/ Departments.

    The proceeding of session will commence again on March 13, ahead of which JK opposition likely to meet senior opposition leaders of the country—(KNO)

    Delhi: Three persons, including a juvenile, were apprehended after a video surfaced on social media showing a group of men allegedly harassing and groping a Japanese woman on Holi, police said on Saturday.

    The video showed a group of men smearing colour on a foreigner, who seemed uncomfortable. It also showed one of the men smashing an egg on her head. She can be heard saying “bye bye” in the video.

    According to the police, the video is of Holi (celebrated on March 8) and was shot an area of Paharganj here.

    The girl in the video is a Japanese tourist who was staying at Paharganj and departed to Bangladesh on Friday, they added.

    The girl has not made any complaint, neither called Delhi Police nor her country’s embassy as confirmed by the embassy official in response to an e-mail, a senior police officer said.

    Police on Friday had said they have taken the notice of the video and were verifying whether it is of a recent incident or an old one.

    People seen in the video have been identified. Three persons, including one juvenile, have been apprehended and questioned. They have confessed their involvement in the incident as seen in the video. They all are residents of a nearby area of Paharganj, Deputy Commissioner of Police (central) Sanjay Kumar Sain said.

    The girl tweeted from her Twitter handle that she has reached Bangladesh and was fit mentally and physically.

    Police said action has been initiated against the accused under the Delhi Police Act. However, further legal action will be decided on merits and in accordance with the complaint by the girl, if any, they added.

    Delhi Commission for Women (DCW) Chairperson Swati Maliwal had said she was issuing a notice to Delhi Police to examine the video and arrest the perpetrators.

    “Very disturbing videos getting viral on social media showing sexual harassment with foreign nationals on Holi! I am issuing notice to Delhi Police to examine these videos and arrest the perpetrators! Completely shameful behaviour!” Maliwal tweeted on Friday.

    The National Commission for Women too took the notice of the video and asked Delhi Police to register an FIR in the matter.

    “@NCWIndia has taken cognizance. Chairperson @sharmarekha has written to @CPDelhi to immediately file FIR in the matter. NCW has also sought a fair and time-bound investigation in the matter. A detailed report must be apprised to the commission,” the NCW tweeted.

    New Delhi: India’s drug regulator has directed drug manufacturers not to use propylene glycol supplied by a Delhi-based company which provided the ingredient to Marion Biotech, whose cough syrups were alleged to have led to the deaths of children in Uzbekistan.

    Maya Chemtech India Pvt. Ltd. supplied propylene glycol used in Marion Biotech’s cough syrups that were found to be “not of standard quality”, according to the regulator.

    Three employees of Marion Biotech were arrested on charges of manufacture and sale of adulterated drugs.

    Also, the drugs inspector from the Central Drugs Standard Control Organisation (CDSCO) North Zone last week issued a notice to the pharmaceutical firm asking it to stop the sale and distribution of the drug concerned, stating that the sample was found to be “not of standard quality”.

    Uzbekistan alleged in December last year that several children died after consuming Marion Biotech’s cough syrups, which it claimed were contaminated with unacceptable amounts of ethylene glycol or propylene glycol.

    According to a communication sent by Drug Controller General of India (DCGI) Rajeev Raghuvanshi to the licensing authorities of all states and Union territories on March 7, during the course of investigation a total of 33 samples were drawn by drugs inspectors. The test reports of 30 drug samples have been received, wherein 24 samples were declared as “not of standard quality”.

    Also, out of these samples, 22 fall under the category of adulterated/spurious under Sections 17A and 178 of the Drugs and Cosmetics Act, 1940.

    “It is further informed that M/s Maya Chemtech India Pvt. Ltd…was mainly the supplier of propylene glycol which has been used in the impugned batches. In view of the above, you are requested to issue directions to all manufacturers in your jurisdiction not to use propylene glycol supplied by Maya Chemtech India Pvt,” the DCGI said in the letter.

    Accordingly, he also requested them to instruct their enforcement officials to keep strict vigil on the matter and take stringent action as per law against the offenders in public interest.

    On January 12, the World Health Organization (WHO) had issued a “medical product alert”, referring to two substandard (contaminated) products, identified in Uzbekistan and reported to it on December 22, 2022.

    “The two products are AMBRONOL syrup and DOK-1 Max syrup. The stated manufacturer of both products is MARION BIOTECH PVT. LTD, (Uttar Pradesh, India). To date, the stated manufacturer has not provided guarantees to WHO on the safety and quality of these products,” the WHO had said then.

    “Laboratory analysis of samples of both products, undertaken by national quality control laboratories of the Ministry of Health of the Republic of Uzbekistan found both products contained unacceptable amounts of diethylene glycol and/or ethylene glycol as contaminants,” it had noted.

    New Delhi: The Enforcement Directorate (ED) on Friday conducted raids at more than 15 places including RJD leader and Bihar Deputy Chief Minister Tejashwi Yadav’s residence in the national capital, in connection with the land for job scam issue.

    The Central Bureau of Investigation (CBI) has recently grilled former Bihar Chief Minister Rabri Devi and Lalu Prasad, the former Railway Minister on the same matter.

    The ED has also conducted raids in Bihar in the IRCTC scam. The ED’s case is on the basis of CBI’s FIR.

    The CBI in its case has alleged that during the investigation, it was found that the accused, in conspiracy with the then GM Central Railways and CPO, Central Railways engaged some persons as substitutes in lieu of land either in their name or in the name of close relatives of Lalu’s family.

    The CBI registered a case against Lalu Prasad, the then Union railway minister, his wife Rabri Devi, two daughters and 15 others, including unknown public servants and private persons.

    “During the period 2004-2009 Yadav obtained pecuniary advantages in the form of transfer of landed property in the name of his family members in lieu of appointment of substitutes in Group ‘D’ Post in different zones of Railways,” the official said.

    A number of residents of Patna themselves or through their family members sold and gifted their land situated at Patna in favour of the family members of Lalu Prasad, and a private company controlled by him and his family. It has been alleged that they were also involved in the transfer of immovable properties.

    New Delhi: Under the leadership of Delhi BJP Working President Virendra Sachdeva on Friday, the saffron party staged a massive protest outside the Aam Aadmi Party (AAP) headquarters demanding resignation of Delhi Chief Minister Arvind Kejriwal.

    A model of Tihar jail was placed at the protest site, inside which former Delhi ministers Satyendar Jain and Manish Sisodia were shown locked, became a special attraction among the protesters and passers-by.

    Apart from this, the Chief Minister’s residence was also shown in the protest, on whose walls the list of corruption cases by the Kejriwal government was also hung.

    Besides Sachdeva, Delhi Opposition leader Ramvir Singh Bidhuri, BJP MPs Ramesh Bidhuri and Parvesh Verma, State BJP General Secretary Kuljeet Singh Chahal, Co-incharge of Assam BJP Pawan Sharma, MLA Abhay Verma and former State BJP President Adesh Gupta addressed a programme to protest against the AAP government in Delhi.

    State BJP Working President said, “The saffron party workers first fought for the resignation of Sisodia and today the results are in front of everyone. Now the next number is of Arvind Kejriwal because Kejriwal himself is the kingpin and mastermind of this entire liquor scam.”

    Sachdeva added: “Kejriwal was saying that he would not celebrate Holi. How could Kejriwal apply the colour of Holi on the face which he hides behind the black money of liquor?”

    He added: “There was talk of free education and health but Kejriwal gave “buy one get one free liquor bottle scheme” to the people of Delhi. A conspiracy was hatched to make the youth intoxicated.”
