SC seeks Centre’s reply on PIL alleging ‘unnecessary’ hysterectomies in Bihar, Raj, Chhattisgarh

New Delhi: The Supreme Court sought the Centre’s response on Monday on a PIL alleging that doctors in Bihar, Rajasthan and Chhattisgarh have been performing “unnecessary hysterectomies”, a surgical procedure to remove the uterus, on poor women just to reap high insurance fees from governments under the Rashtriya Swasthya Bima Yojana (RSBY).
A bench headed by Chief Justice DY Chandrachud also sought the assistance of Additional Solicitor General Aishwarya Bhati to deal with the public interest litigation (PIL) matter filed by Narendra Gupta, himself a medical practitioner.
The bench, also comprising Justices PS Narasimha and JB Pardiwala, granted four weeks’ time to the Centre for filing its response to the PIL.
A hysterectomy is a surgical procedure to remove the uterus after which a woman can neither conceive nor can have menstrual periods regardless of her age.
The PIL, based on media reports and researched facts, alleged a “widespread pattern of doctors performing medically unnecessary hysterectomies to reap high insurance fees from the government” in states such as Bihar, Rajasthan and Chhattisgarh.
It sought compensation for the victim women and meaningful policy changes to deal with the problem.
The women, aided by heavily-subsidised state-funded health insurance schemes, usually go to private hospitals for medical care for symptoms such as “abdominal pain and general weakness” and doctors resort to “unnecessary hysterectomy operations after cursory, or in some cases, no medical examinations”, the petition alleged.
“The present petition has been filed in the nature of public interest litigation…and arises from an influx of news stories and Right to Information (RTI) results in the states of Bihar, Chhattisgarh and Rajasthan regarding unlawful hysterectomies and related insurance scams,” it said.

The petition sought directions to the state governments “to implement monitoring, inspection and accountability mechanisms for the private healthcare industry”, which are empanelled to serve the poor covered under the government’s Rashtriya Swasthya Bima Yojana (RSBY).
The RSBY has been launched by the Union Ministry of Labour and Employment to provide a health insurance coverage to Below Poverty Line (BPL) families.
The objective of the scheme is to provide protection to BPL households from financial liabilities arising out of health shocks that involve hospitalisation.

Adani row: SC refuses to accept Centre’s suggestions on expert panel in sealed cover

New Delhi: The Supreme Court on Friday refused to accept in a sealed cover the Centre’s suggestion on a proposed panel of experts for strengthening regulatory measures for the stock market.
Observing that it wants to maintain full transparency in the interests of investors, a bench comprising Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala said it would rather not accept the Centre’s suggestion in a sealed cover.
“We will not accept the sealed cover suggestion by you because we want to maintain full transparency,” the bench said.
On February 10, the top court had said the interests of Indian investors need to be protected against market volatility in the backdrop of the Adani Group stock rout and asked the Centre to consider setting up a panel of domain experts headed by a former judge to look into strengthening the regulatory mechanism.
Till now, four PILs have been filed in the top court on the issue by lawyers M L Sharma and Vishal Tiwari, Congress leader Jaya Thakur and activist Mukesh Kumar.
Adani Group stocks have taken a beating on the bourses after the Hindenburg Research made a litany of allegations, including fraudulent transactions and share-price manipulation, against the business conglomerate.
The Adani Group has dismissed the charges as lies, saying it complies with all laws and disclosure requirements.

Despite Centre’s bias, Telangana witnesses investments, says KTR

Hyderabad: Telangana IT and Industries Minister KT Rama Rao (KTR) said despite the Centre’s political bias, investments were coming Telangana’s way.
He emphasised that even though the Centre had pledged to authorise the railway coach plant in Kazipet, the Telangana government had made it possible for Medha Servo to create India’s largest private coach factory, which would soon begin producing Vande Bharat coaches.
Through TS-iPASS, the State has generated 22 lakh direct jobs and attracted investments of Rs. 3.32 lakh crore during the past eight and a half years, said KTR.
KTR stated that as no government could employ everyone in the public sector, the state government was encouraging the formation of enterprises in the private sector during a discussion on the IT and Industry departments in the Assembly on Friday. Multiple industry-specific industrial parks were being promoted by the State government all around the State.
He wanted BJP leaders to be present in order to persuade the Center and get the required funding for the State’s IT and industrial sectors. He encouraged people to protect the State from such leaders because “instead of helping to develop the state, the Opposition leaders are now anxious to demolish public properties like Pragathi Bhavan and the state Secretariat.”
According to KTR, Telangana was the first state to set up Industrial Health Clinics to aid struggling companies. As a result, 249 units received financial support, 455 units received consulting services, and 466 units received diagnostic tests, preventing them from being shut down. He acknowledged that since Telangana was formed, the state government had paid out Rs 3,933 crore in industrial incentives, and the remaining Rs 3,400 crore could not be paid out.
KTR claimed that by imposing a five percent tax and dismantling the All India Handloom Board, All India Powerloom Board, and other organisations, Prime Minister Narendra Modi was working against the handloom industry.
He recalled the withdrawal of the thrift fund, health, and life insurance programmes for weavers. He claimed that the genuine motto of the BJP government at the Centre was “Sab ka Saath, Sab ka Satyanash.”

Centre’s policy root cause of Kerala’s economic crisis: FM Balagopal

Thiruvananthapuram: Kerala Finance Minister K N Balagopal, during the budget presented by him in the State Assembly here on Friday, attacked the BJP-led Centre by alleging that its policy was the root cause of the economic crisis in the southern state.
In his budget speech, Balagopal claimed that the centralisation of power and disregard for states, especially Kerala, has increased in an unprecedented manner.
Launching a scathing attack on the Centre, Balagopal, also a prominent leader of the state’s ruling CPI(M), said that change in fiscal federalism that goes against the spirit of the Constitution was a more serious threat than any other issue.
“During the tenure of the 10th Finance Commission, the share of Kerala was 3.875 per cent of the divisible pool to be distributed among the states. By the time of the 15th Finance Commission, it came down to 1.925 per cent. Through this, the Union government cut down the revenue of Kerala by tens of thousands of crores,” he charged.
The minister said there is a shortfall of around Rs 6,700 crore due to the reduction of the Revenue Deficit Grant by the Union government.
“As a result of the cessation of GST compensation, there has been a shortfall of around Rs 7,000 crore during the current fiscal. As a result of the policy of the Union government treating Public Accounts as debt liability, there is a revenue loss of around Rs 10,000 crore per annum,” Balagopal said.
He said the policy of treating the liability of institutions like Kerala Infrastructure Investment Fund Board (KIIFB), Social Security Pension Limited, etc., which raise funds from outside the budgetary allocation as that of the state, is also limiting the government’s borrowing capacity.
“There will also be a shortfall of Rs 3,100 crore on this account. Due to the restriction on the market borrowing limit, there has been a shortfall of around Rs 4,000 crore in the resource mobilisation,” the minister said.
He said it is anticipated that the fiscal constraints in 2023-2024 will be more than that of the current year. “This is because of the anticipated shortage of Rs 8,400 crore in Revenue Deficit Grant compared to 2022-23, the loss of around Rs 5,700 crore due to the cessation of GST compensation, the resource loss of around Rs 5,000 crore due to the restriction on the borrowing limit as well as the reduction on account of the debt likely to be borne by KIIFB and the Social Security Pension company during next year,” Balagopal said.

As the state recovers from the economic crisis and is on the path of growth, the fiscal policy of the Union government will adversely affect growth prospects, he added.
Stating that Kerala is countering serious constraints, he said in the current scenario, the state cannot surpass the strict and rigid norms stipulated by the Centre.
“The taxation powers of the state are limited. The borrowing powers are also strictly restricted. We have to understand the situation and move forward irrespective of party politics,” he said.
Balagopal said the state government was not of the opinion that loans should be given to debt-ridden corporates from the hard-earned money of common people by investing it in various financial institutions.
“Our opinion is that the Central and the State governments shall carry out more developmental, welfare activities by availing more loans. But the Union government is reluctant to relax the conservative stance,” he said.
Balagopal said the Left government considers the conservative financial policy enforced by the Union government as the biggest challenge to the alternative development model of Kerala.
“But we are not ready to abandon our alternative model or its virtues in spite of the hurdles posed by the Union government. Kerala has not reached here without facing any crisis,” he said.
A significant change towards the financial developmental planning approach is required to survive this new situation that has arisen due to the curtailing of the fiscal space, he added.

Budget 2023: 2 AI centres of excellence, 100 5G labs for developing apps

New Delhi: Three centers of excellence for artificial intelligence in top educational institutions and 100 labs in engineering institutions for developing applications using 5G services will be set up, Union Finance Minister Nirmala Sitharaman announced on Wednesday.
The finance minister made the announcement in her budget speech in Lok Sabha.
“Three centers of excellence for artificial intelligence will be set up in top educational institutions. Leading industry players will partner in conducting interdisciplinary research, developing cutting-edge applications and scalable problem solutions in the areas of agriculture, health, and sustainable cities,” she said.
Sitharaman said that a total of 100 labs will be set up in engineering institutions in collaboration with various authorities, regulators, banks, and other businesses for developing applications using 5G services.
“To realize the new range of opportunities, business models, and employment potential, the labs will cover, among others, applications such as smart classrooms, precision farming, intelligent transport systems, and healthcare applications,” she said.
The finance minister announced that to address learning loss incurred during the pandemic years, a national digital library for children and adolescents will be set up for facilitating the availability of quality books across geographies, languages, and genres.
As many as 38,000 teachers and support staff to be recruited in the next three years for 740 Eklavya Model Residential Schools serving 3.5 lakh tribal students, she said.
Sitharaman also announced that teachers’ training will be re-envisioned through innovative pedagogy, curriculum transaction, continuous professional development dipstick survey, and ICT implementation.

“Lab grown diamonds is a technology and innovation-driven, an energy-driven sector with high employment potential. To encourage indigenous production of such diamonds, a research grant will be provided to one of the IITs for five years,” she said.

PIL filed in SC challenging Centre’s decision to ban BBC documentary

New Delhi: A PIL has been filed in the Supreme Court against the Centre’s decision to “ban” a BBC documentary on the 2002 Gujarat riots in the country, alleging it was “malafide, arbitrary and unconstitutional”.
The PIL filed by advocate ML Sharma also urged the apex court to call and examine the BBC documentary – both parts I and II – and sought action against persons who were responsible and were involved directly and indirectly with the 2002 Gujarat riots.
Sharma said that in his PIL he has raised a constitutional question and the top court has to decide whether citizens have the right under Article 19 (1) (2) to see news, facts and reports on the 2002 Gujarat riots.
He has sought direction to quash the order dated January 21, 2023 of the Ministry of the Information and Broadcasting, terming it as illegal, malafide, arbitrary and unconstitutional.
His plea said whether the central government can curtail freedom of press which is a fundamental right as guaranteed under Article 19 (1) (2) of the Constitution.
“Whether without having an Emergency declared under Article 352 of the Constitution of India by the president, Emergency provisions can be invoked by the central government?” the PIL said.’
It claimed the BBC documentary has “recorded facts” which are also “evidence” and can be used to further the cause of justice for the victims.
On January 21, the Centre issued directions for blocking multiple YouTube videos and Twitter posts sharing links to the controversial BBC documentary “India: The Modi Question”, according to sources.

Delhi HC directs Kejriwal govt to set up one-stop centres for women, children

New Delhi: The Delhi High Court on Friday asked the Arvind Kejriwal-led AAP government to set up ‘One-Stop Centres’ for women and children in every district in compliance with a Supreme Court decision of 2018.
The court’s direction came while a division bench comprising Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad was hearing a plea against media houses for revealing the victim’s identity and accused persons’ name in a rape case of Hyderabad.
The court directed the Delhi government to act under the relevant section(s) of the Indian Penal Code and lay down the criteria as directed by the Supreme Court for identifying social welfare institutions or organisations, to whom the next-of-kin to give the authorisation for declaration of the name.
The court referred to the Supreme Court judgement in Nipun Saxena vs Union of India passed on December 11, 2018.
The bench also noted that the Delhi government has not followed the Supreme Court order to date, wherein the court had requested the state governments and Union Territories to set up at least one one-stop centre in every district within one year of the judgment.
The top court had ruled that the centres should employ well-trained staff, have sufficient medical facilities with counsellors and psychiatrists available on call and video conferencing facility for recording statements of the victims and courtrooms for the trial of such cases in an attempt to make such centres a central police station where all women-and children-related crimes are registered.
The bench said: “The state governments are already in contempt in not adhering to the time limit fixed by the Supreme Court in setting up such centres within one year from the date of the judgment passed on December 11, 2018.”
The high court also said that it does not find it appropriate to initiate proceedings against media houses and reported individuals or to direct investigating authorities to take cognisance of the offence.

“With these observations, the writ petition is disposed of, along with pending applications, if any,” the court said.

Centre’s intervention in judiciary a danger: Former Karnataka SC judge

Mysuru: Former Karnataka Lokayukta and Supreme Court judge, Justice N. Santhosh Hegde (retd) on Tuesday termed the Union government’s intervention in the appointment of judges and in the judicial system incorrect and “dangerous”.
At an interaction programme with media, he underlined that the executive should not intervene with the judiciary. “This kind of intervention is a dangerous development,” he warned.
“The politicians will not have any knowledge about the judiciary. If this is the case, it is not tenable to intervene in the appointment of judges or in the matters of judiciary,” Hegde said.
“I didn’t know much about the society before becoming Lokayukta. Those who become rich will get all the respect. Those who come out of jail are received with grand welcome,” he said.
Hegde further said that there is danger of the country getting divided on the lines of religion and language. However, one can’t say when it is going to happen, he added.
“Corruption is rampant in the country. The representatives of the people are having the feeling of being owners of the people. The politicians are just talking about corruption and making allegations against each other. No one wants to correct it,” he said.
If this situation continues, people will rebel against the system, he said, but added that he wouldn’t know when this situation will come.
“I got many awards, recognitions. I have donated money to organisations. I have not accepted money from anyone. I own an apartment and nothing else. We have to be clean,” he said.

Hedge also said that the delay in disposal of cases should not happen, but society is getting a different message as mediators are being approached for solutions.
