According to the rules, people now living in other states have married a Kashmiri girl. They can also now become permanent residents of the state. The government will issue domicile certificates for them.


As long as Article 370 and Article 35A were in force in Jammu and Kashmir, only women would have been permanent residents of Kashmir, her children and husband were excluded from this ambit. 

If a Kashmiri man married a woman, he and his children were considered permanent citizens. The rule was already relaxed in connection with men.

They could marry a woman from any other state, the children who came from those were considered permanent citizens of Kashmir.

The administration’s decision is said to be to end gender inequality. The notification has been issued by the Jammu and Kashmir Administration on 20th July 2021. 

The Narendra Modi government at the Centre had proposed to remove the section on August 5, 2019. The proposal for reorganization of Jammu and Kashmir was placed. 

The same motion was moved in the Lok Sabha on 6th August, which was passed after negotiations in both the Houses. 

Articles 370 and 35A were adjourned. Because of this article, many laws of the country were not applicable in Jammu and Kashmir.
